        SENATOR EARLY, CONSTITUTIONAL CHANGES AND FEDERAL
           RELATIONS, IN SENATE, AS AMENDED, FEBRUARY 15, 1978

                               A JOINT RESOLUTION

     1  Making application to the Congress of the United States to call
     2     a convention for drafting and proposing an amendment to the
     3     Constitution of the United States to guarantee the right to
     4     life to the unborn fetus.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby resolves as follows:
     7     Section 1.  The General Assembly of the Commonwealth of
     8  Pennsylvania (the Senate concurring) hereby makes application to
     9  the Congress of the United States, in accordance with the
    10  provisions of Article V of the Constitution of the United
    11  States, to call a convention for drafting and proposing an
    12  amendment to the Constitution of the United States to guarantee
    13  the right to life to the unborn fetus by doing the following:
    14     (a)  With respect to the right to life guaranteed in the
    15  United States Constitution, provide that every human being

     1  subject to the jurisdiction of the United States or any state
     2  shall be deemed from the moment of fertilization to be a person
     3  and entitled to the right to life.
     4     (b)  Provide that Congress and the several states shall have
     5  concurrent powers to enforce such an amendment by appropriate
     6  legislation.
     7     (c)  The purpose of the Constitutional Convention shall be to
     8  only consider the above and no other business.
     9     (D)  NOTHING IN THIS ARTICLE SHALL PROHIBIT A LAW PERMITTING   <--
    10  ONLY THOSE MEDICAL PROCEDURES REQUIRED TO PREVENT THE DEATH OF
    11  THE MOTHER.
    12     Section 2.  The Secretary of the Commonwealth shall transmit
    13  certified copies of this resolution to the President of the
    14  Senate of the United States and to the Speaker of the House of
    15  Representatives of the United States and to the President of the
    16  Senate and Speaker of the House of Representatives of the
    17  Legislatures of each of the other forty-nine States of the
    18  United States.
