           JUNE 30, 1976

                                  A SUPPLEMENT

     1  To the act of July 7, 1972 (P.L.743, No.176), entitled "An act
     2     providing for the establishment and operation of Lincoln
     3     University as an instrumentality of the Commonwealth to serve
     4     as a State-related institution in the higher education system
     5     of the Commonwealth; providing for change of name; providing
     6     for the composition of the board of trustees; terms of
     7     trustees, and the power and duties of such trustees;
     8     providing for preference to Pennsylvania residents in
     9     tuition; authorizing appropriations in amounts to be fixed
    10     annually by the General Assembly; providing for the auditing
    11     of accounts of expenditures from said appropriations;
    12     providing for public support and capital improvements;
    13     authorizing the issuance of bonds exempt from taxation within
    14     the Commonwealth; requiring the President to make an annual
    15     report of the operations of Lincoln University," making
    16     appropriations for carrying the same into effect, providing
    17     for a basis for payments of such appropriation, and providing
    18     a method of accounting for the funds appropriated.

    19     The General Assembly of the Commonwealth of Pennsylvania
    20  hereby enacts as follows:
    21     Section 1.  The following sums, or as much thereof as may be
    22  necessary, is hereby specifically appropriated to the Trustees
    23  of the College of Lincoln University, Chester County, for the
    24  fiscal period July 1, 1976 to June 30, 1977, for the purposes
    25  and in the amounts as shown:


     1     (1)  For instruction.............................  $2,525,000  <--

     8     Section 2.  Payments to Lincoln University on account of the
     9  appropriations for the items provided in section 1 shall be made
    10  on the basis of costs during the fiscal period.
    11     Section 3.  Payments to Lincoln University of the
    12  appropriation herein provided shall be made monthly during the
    13  fiscal period.
    14     Such monthly payments shall be made in accordance with the
    15  provisions of section 2, on the basis of estimated costs. The
    16  estimate of costs shall be submitted by Lincoln University to
    17  the Secretary of Education, the General Assembly and to the
    18  State Treasurer not later than 30 days prior to the date on
    19  which such payment is to be made.
    20     Section 4.  Lincoln University shall apply the moneys
    21  appropriated by this act only for such purposes as are permitted
    22  in this act and shall at all times maintain proper records
    23  showing the application of such moneys. Not later than 120 days
    24  after the close of the fiscal period to which this act relates,
    25  Lincoln University shall file with the Secretary of Education,
    26  the General Assembly and with the Auditor General of the
    27  Commonwealth a statement setting forth the amounts and purposes
    28  of all expenditures made from moneys appropriated by this act
    29  and costs, as provided in section 2, used as a basis for receipt
    30  of any appropriation during said fiscal period. Such statement

     1  of expenditures and costs shall be reviewed by the Auditor
     2  General of the Commonwealth, and he shall have the right, in
     3  respect to the moneys appropriated by this act, to audit and
     4  disallow expenditures made for purposes not permitted by this
     5  act. The Auditor General shall also make a determination of
     6  costs and make certification as to their correctness. In respect
     7  to expenditures made by the university from moneys other than
     8  those appropriated by this act, the Auditor General shall have
     9  the right to review only and he shall file annually with the
    10  General Assembly such information concerning said expenditures
    11  as the General Assembly or any of its committees may require.
    12     Section 5.  The university shall provide such information and
    13  in such form and manner as the Department of Education may
    14  prescribe.
    15     Section 6.  The university shall report its revenues and
    16  expenditures and present its financial statements required under
    17  the provisions of this act in accordance with generally accepted
    18  accounting principles and procedures for educational
    19  institutions as set forth in the "Higher Education Finance
    20  Manual of 1975," without exception.
    21     Section 7.  A report shall be submitted to the Governor and
    22  the Appropriations and Education Committees of the Senate and
    23  House of Representatives and shall include data for all programs
    24  of the university except the Doctor of Medicine program. The
    25  report, to be submitted prior to November 1, 1977, shall cover
    26  the twelve-month period beginning September 1, 1976. The report
    27  shall include for each term during the period:
    28     (1)  The following counts and distributions:
    29     (i)  The definitions and numbers of full-time faculty
    30  members, of part-time faculty members, of full-time students

     1  enrolled in graduate courses, of full-time students enrolled in
     2  undergraduate courses, of part-time students enrolled in
     3  graduate courses, and of part-time students enrolled in
     4  undergraduate courses.
     5     (ii)  A distribution of part-time faculty members by the
     6  percentage of full-time employment.
     7     (iii)  Total numbers of undergraduate student credit hours,
     8  divided into lower division and upper division levels, and of
     9  graduate student credit hours divided into three levels --
    10  master's, first professional and doctoral.
    11     (iv)  Number of different courses scheduled by level of
    12  instruction, distributed by the number of sections scheduled in
    13  each course and the sections distributed by the number of
    14  students enrolled in each section.
    15     (v)  Number of terms scheduled and the dates thereof.
    16     (2)  A classification of faculty members or other
    17  professional employees by title including: professor, associate
    18  professor, assistant professor, instructor, lecturer, research
    19  associate, librarian, and academic administrator; faculty
    20  members or other professional employees under each title to be
    21  subdivided by type of assignment undergraduate courses only,
    22  graduate courses only, or both graduate and undergraduate
    23  courses; and each such set of faculty members or other
    24  professional employees to be further subdivided by type of
    25  employment, full-time or part-time; and the following aggregates
    26  for each such subdivided classification:
    27     (i)  The number.
    28     (ii)  The sum of credits assigned to undergraduate courses
    29  and the sum of credits assigned to graduate courses taught,
    30  divided into lower division, upper division, master's, first

     1  professional and doctoral levels.
     2     (iii)  The sum of undergraduate student credit hours and the
     3  sum of graduate student credit hours generated; divided into
     4  lower division, upper division, master's, first professional and
     5  doctoral levels.
     6     (iv)  Total salary paid.
     7     (v)  Total salary paid from university funds.
     8     (vi)  Total salary paid from Federal funds.
     9     (vii)  Total salary paid from other funds.
    10     (3)  For each term of the period covered for each full-time
    11  faculty member identified by school, department and title:
    12     (i)  An analysis of the average hours per week spent in
    13  university-related activities, stating specifically hours spent
    14  in undergraduate classroom contact and graduate classroom
    15  contact, hours spent in preparation, hours spent in research and
    16  hours spent in public service.
    17     (ii)  The total salary paid and the salary paid from
    18  university funds.
    19     Section 8.  In addition to the requirements of section 7, the  <--
    20  report covering the twelve-month period beginning September 1,
    21  1976, shall include for all programs of the university except
    22  the Doctor of Medicine program:
    23     (1) (4)  Minimum number of credits required for a              <--
    24  baccalaureate degree, and for a master's degree.
    25     (2) (5)  Number of bachelor's degrees, master's degrees,       <--
    26  first professional degrees, and doctoral degrees awarded in
    27  1974, 1975 and 1976 and estimated 1977.
    28     Section 9 8.  Lincoln University shall provide such            <--
    29  information and in such form and manner as the Department of
    30  Education may prescribe.

     1     Section 10 9.  This act shall take effect July 1, 1976.        <--
