A SUPPLEMENT 1 To the act of July 7, 1972 (P.L.743, No.176), entitled "An act 2 providing for the establishment and operation of Lincoln 3 University as an instrumentality of the Commonwealth to serve 4 as a State-related institution in the higher education system 5 of the Commonwealth; providing for change of name; providing 6 for the composition of the board of trustees; terms of 7 trustees, and the power and duties of such trustees; 8 providing for preference to Pennsylvania residents in 9 tuition; authorizing appropriations in amounts to be fixed 10 annually by the General Assembly; providing for the auditing 11 of accounts of expenditures from said appropriations; 12 providing for public support and capital improvements; 13 authorizing the issuance of bonds exempt from taxation within 14 the Commonwealth; requiring the President to make an annual 15 report of the operations of Lincoln University," making 16 appropriations for carrying the same into effect, providing 17 for a basis for payments of such appropriation, and providing 18 a method of accounting for the funds appropriated. 19 The General Assembly of the Commonwealth of Pennsylvania 20 hereby enacts as follows: 21 Section 1. The following sums, or as much thereof as may be 22 necessary, is hereby specifically appropriated to the Trustees 23 of the College of Lincoln University, Chester County, for the 24 fiscal period July 1, 1975 to June 30, 1976, for the purposes 25 and in the amounts as shown: 26 (1) For general institutional expenses ......... $2,428,000
1 (2) For advanced institution development........ 250,000 2 (3) For accreditation improvement............... 100,000 3 Section 2. Payments to Lincoln University on account of the 4 appropriations for the items provided in section 1 shall be made 5 on the basis of costs during the fiscal period. 6 Section 3. Payments to Lincoln University of the 7 appropriation herein provided shall be made monthly during the 8 fiscal period. 9 Such monthly payments shall be made in accordance with the 10 provisions of section 2, on the basis of estimated costs. The 11 estimate of costs shall be submitted by Lincoln University to 12 the Secretary of Education, the General Assembly and to the 13 State Treasurer not later than 30 days prior to the date on 14 which such payment is to be made. 15 Section 4. Lincoln University shall apply the moneys 16 appropriated by this act only for such purposes as are permitted 17 in this act and shall at all times maintain proper records 18 showing the application of such moneys. Not later than 120 days 19 after the close of the fiscal period to which this act relates, 20 Lincoln University shall file with the Secretary of Education, 21 the General Assembly and with the Auditor General of the 22 Commonwealth a statement setting forth the amounts and purposes 23 of all expenditures made from moneys appropriated by this act 24 and costs, as provided in section 2, used as a basis for receipt 25 of any appropriation during said fiscal period. Such statement 26 of expenditures and costs shall be reviewed by the Auditor 27 General of the Commonwealth, and he shall have the right, in 28 respect to the moneys appropriated by this act, to audit and 29 disallow expenditures made for purposes not permitted by this 30 act. The Auditor General shall also make a determination of 19750S0777B1010 - 2 -
1 costs and make certification as to their correctness. In respect 2 to expenditures made by the university from moneys other than 3 those appropriated by this act, the Auditor General shall have 4 the right to review only and he shall file annually with the 5 General Assembly such information concerning said expenditures 6 as the General Assembly or any of its committees may require. 7 Section 5. There shall be no further disbursement of funds <-- 8 appropriated for Lincoln University after September 30, 1975, 9 until the Chairpersons of the House and Senate Appropriations 10 Committees and the Chairpersons of the House and Senate 11 Education Committees have received copies of letters notifying 12 at least a 5% reduction of the current full-time faculty members 13 or full-time equivalent faculty members, and at least a 5% 14 reduction of the current administrators and one vice president 15 at the university as of September 1, 1976. When the Chairpersons 16 of the respective committees have received proof of reduction 17 notification they shall then notify the Treasurer of the 18 Commonwealth who may authorize disbursements from appropriated 19 funds to the university. 20 As an additional condition precedent to the disbursement of 21 appropriated funds after September 30, 1975 to the university, 22 the university shall furnish satisfactory evidence to the 23 Chairpersons of the House and Senate Appropriations Committees 24 and the Chairpersons of the House and Senate Education 25 Committees that, commencing with the academic year that begins 26 in September 1975, all programs of academic fee remission and 27 tuition waiver for all employees of the university are 28 abolished. 29 Section 6 5. The university shall provide such information <-- 30 and in such form and manner as the Department of Education may 19750S0777B1010 - 3 -
1 prescribe. 2 Section 7 6. The university shall report its revenues and <-- 3 expenditures and present its financial statements required under 4 the provisions of this act in accordance with generally accepted 5 accounting principles and procedures for educational 6 institutions as set forth in the "Industry Audit Guide for 7 Colleges and Universities" of the American Institute of 8 Certified Public Accountants of 1973, without exception. 9 Section 8 7. A report shall be submitted to the Governor and <-- 10 the Appropriations and Education Committees of the Senate and 11 House of Representatives and shall include data for all programs 12 of the university except the Doctor of Medicine program. The 13 report, to be submitted prior to November 1, 1976, shall cover 14 the twelve-month period beginning September 1, 1975. The report 15 shall include for each term during the period: 16 (1) The following counts and distributions: 17 (i) The definitions and numbers of full-time faculty 18 members, of part-time faculty members, of full-time students 19 enrolled in graduate courses, of full-time students enrolled in 20 undergraduate courses, of part-time students enrolled in 21 graduate courses, and of part-time students enrolled in 22 undergraduate courses. 23 (ii) A distribution of part-time faculty members by the 24 percentage of full-time employment. 25 (iii) Total numbers of undergraduate student credit hours, 26 divided into lower division and upper division levels, and of 27 graduate student credit hours divided into three levels -- 28 master's, first professional and doctoral. 29 (iv) Number of different courses scheduled by level of 30 instruction, distributed by the number of sections scheduled in 19750S0777B1010 - 4 -
1 each course and the sections distributed by the number of 2 students enrolled in each section. 3 (v) Number of terms scheduled and the dates thereof. 4 (2) A classification of faculty members or other 5 professional employees by title including: professor, associate 6 professor, assistant professor, instructor, lecturer, research 7 associate, librarian, and academic administrator; faculty 8 members or other professional employees under each title to be 9 subdivided by type of assignment undergraduate courses only, 10 graduate courses only, or both graduate and undergraduate 11 courses; and each such set of faculty members or other 12 professional employees to be further subdivided by type of 13 employment, full-time or part-time; and the following aggregates 14 for each such subdivided classification: 15 (i) The number. 16 (ii) The sum of credits assigned to undergraduate courses 17 and the sum of credits assigned to graduate courses taught, 18 divided into lower division, upper division, master's, first 19 professional and doctoral levels. 20 (iii) The sum of undergraduate student credit hours and the 21 sum of graduate student credit hours generated; divided into 22 lower division, upper division, master's, first professional and 23 doctoral levels. 24 (iv) Total salary paid. 25 (v) Total salary paid from university funds. 26 (vi) Total salary paid from Federal funds. 27 (vii) Total salary paid from other funds. 28 (3) For each term of the period covered for each full-time 29 faculty member identified by school, department and title: 30 (i) An analysis of the average hours per week spent in 19750S0777B1010 - 5 -
1 university-related activities, stating specifically hours spent 2 in undergraduate classroom contact and graduate classroom 3 contact, hours spent in preparation, hours spent in research and 4 hours spent in public service. 5 (ii) The total salary paid and the salary paid from 6 university funds. 7 Section 9 8. In addition to the requirements of section 8 7, <-- 8 the report covering the twelve-month period beginning September 9 1, 1975, shall include for all programs of the university except 10 the Doctor of Medicine program: 11 (1) Minimum number of credits required for a baccalaureate 12 degree, and for a master's degree. 13 (2) Number of bachelor's degrees, master's degrees, first 14 professional degrees, and doctoral degrees awarded in 1973, 1974 15 and 1975 and estimated 1976. 16 Section 10 9.
