                                  A SUPPLEMENT

     1  To the act of April 1, 1863 (P.L.213, No.227), entitled "An act
     2     to accept the grant of Public Lands, by the United States, to
     3     the several states, for the endowment of Agricultural
     4     Colleges," making appropriations for carrying the same into
     5     effect, providing for a basis for payments of such
     6     appropriations and providing a method of accounting for the
     7     funds appropriated.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  In order to carry into effect the act of
    11  Congress, approved July 2, 1862, granting public land to the
    12  several states for educational purposes, and subsequent acts of
    13  Congress related thereto, and the act of the General Assembly of
    14  Pennsylvania accepting the provisions and conditions of said
    15  acts of Congress and pledging the faith of the State to carry
    16  the same into effect, the following sums or as much thereof as
    17  may be necessary are hereby specifically appropriated to the
    18  Trustees of the Pennsylvania State University for the fiscal
    19  year July 1, 1975 to June 30, 1976, for the purposes and in the
    20  amounts as shown:
    21     (1)  For general institutional expenses                        <--

     3     (3)  For net cost of extension and public
     4          services..................................     9,626,000
     5     (4)  For net cost of research..................    17,064,000
     6     (5)  For instruction - Doctor of Medicine
     7          only......................................     2,665,000
     8     Section 2.  Payments to Pennsylvania State University on
     9  account of the appropriations for all items as provided in
    10  section 1 except for instruction - Doctor of Medicine shall be
    11  made on the basis of costs during the fiscal year.
    12     Payments for instruction - Doctor of Medicine shall be made
    13  on the basis of full-time equivalent students enrollment at the
    14  rate of $7,465 per student.
    15     Section 3.  If necessary, the Pennsylvania State University
    16  may transfer funds among the appropriations listed in section 1,
    17  clauses (1), (2), (3) and (4): Provided, That the aggregate
    18  amount transferred into or out of each appropriation during the
    19  fiscal year shall not exceed 5% of the amount specifically
    20  appropriated for that purpose.
    21     Section 4.  Payments to the Pennsylvania State University of
    22  the appropriations herein provided shall be made monthly during
    23  the fiscal year.
    24     Such monthly payments shall be made in accordance with the
    25  provisions of sections 2 and 3, on the basis of estimated costs
    26  and full-time equivalent students enrolled in the Doctor of
    27  Medicine program. The estimate of costs shall be submitted by
    28  the Pennsylvania State University to the Secretary of Education,
    29  the General Assembly and to the State Treasurer not later than
    30  30 days prior to the date on which such payment is to be made.

     1     Section 5.  The Pennsylvania State University shall apply the
     2  moneys appropriated by this act only for such purposes as are
     3  permitted in this act and shall at all times maintain proper
     4  records showing the application of such moneys. Not later than
     5  120 days after the close of the fiscal year to which this act
     6  relates, the Pennsylvania State University shall file with the
     7  Secretary of Education, the General Assembly, and with the
     8  Auditor General of the Commonwealth, a statement setting forth
     9  the amounts and purposes of all expenditures made from moneys
    10  appropriated by this act and other university accounts during
    11  said fiscal year, the number of full-time equivalent students
    12  enrolled in the Doctor of Medicine program and costs, as
    13  provided in sections 2 and 3, used as a basis for receipt of any
    14  appropriation during said fiscal year.
    15     Such statement of expenditures and number of full-time
    16  equivalent students enrolled in the Doctor of Medicine program
    17  and costs shall be reviewed by the Auditor General of the
    18  Commonwealth, and he shall have the right, in respect to the
    19  moneys appropriated by this act, to audit and disallow
    20  expenditures made for purposes not permitted by this act and to
    21  cause such sums to be recovered and paid by the Pennsylvania
    22  State University to the Treasurer of the Commonwealth. The
    23  Auditor General shall also make a determination of full-time
    24  equivalent students enrolled in the Doctor of Medicine program
    25  and costs and make a certification as to their correctness. In
    26  respect to expenditures made by the university from moneys other
    27  than those appropriated by this act, the Auditor General shall
    28  have the right to review only and he shall file annually with
    29  the General Assembly such information concerning such
    30  expenditures as the General Assembly or any of its committees

     1  may require.
     2     Section 6.  A report shall be submitted to the Governor and
     3  the Appropriations and Education Committees of the Senate and
     4  House of Representatives and shall include data for all programs
     5  of the university except the Doctor of Medicine program. The
     6  report, to be submitted prior to November 1, 1976, shall cover
     7  the twelve-month period beginning September 1, 1975. The report
     8  shall include for each term during the period:
     9     (1)  The following counts and distributions:
    10     (i)  The definitions and numbers of full-time faculty
    11  members, of part-time faculty members, of full-time students
    12  enrolled in graduate courses, of full-time students enrolled in
    13  undergraduate courses, of part-time students enrolled in
    14  graduate courses, and of part-time students enrolled in
    15  undergraduate courses.
    16     (ii)  A distribution of part-time faculty members by the
    17  percentage of full-time employment.
    18     (iii)  Total numbers of undergraduate student credit hours,
    19  divided into lower division and upper division levels, and of
    20  graduate student credit hours divided into three levels--
    21  master's, first professional and doctoral.
    22     (iv)  Number of different courses scheduled by level of
    23  instruction, distributed by the number of sections scheduled in
    24  each course and the sections distributed by the number of
    25  students enrolled in each section.
    26     (v)  Number of terms scheduled and the dates thereof.
    27     (2)  A classification of faculty members or other
    28  professional employees by title including: professor, associate
    29  professor, assistant professor, instructor, lecturer, research
    30  associate, librarian, and academic administrator; faculty

     1  members or other professional employees under each title to be
     2  subdivided by type of assignment: undergraduate courses only,
     3  graduate courses only, or both graduate and undergraduate
     4  courses; and each such set of faculty members or other
     5  professional employees to be further subdivided by type of
     6  employment: full-time or part-time; and the following aggregates
     7  for each such subdivided classification:
     8     (i)  The number.
     9     (ii)  The sum of credits assigned to undergraduate courses
    10  and the sum of credits assigned to graduate courses taught,
    11  divided into lower division, upper division, master's, first
    12  professional and doctoral levels.
    13     (iii)  The sum of undergraduate student credit hours and the
    14  sum of graduate student credit hours generated; divided into
    15  lower division, upper division, master's, first professional and
    16  doctoral levels.
    17     (iv)  Total salary paid.
    18     (v)  Total salary paid from university funds.
    19     (vi)  Total salary paid from Federal funds.
    20     (vii)  Total salary paid from other funds.
    21     (3)  For each term of the period covered for each full-time
    22  faculty member identified by school, department and title:
    23     (i)  An analysis of the average hours per week spent in
    24  university-related activities, stating specifically hours spent
    25  in undergraduate classroom contact and graduate classroom
    26  contact, hours spent in preparation, hours spent in research and
    27  hours spent in public service.
    28     (ii)  The total salary paid and the salary paid from
    29  university funds.
    30     Section 7.  In addition to the requirements of section 6, the

     1  report covering the twelve-month period beginning September 1,
     2  1975, shall include for all programs of the university except
     3  the Doctor of Medicine program:
     4     (1)  Minimum number of credits required for a baccalaureate
     5  degree, and for a master's degree.
     6     (2)  Number of bachelor's degrees, master's degrees, first
     7  professional degrees, and doctoral degrees awarded in 1973, 1974
     8  and 1975 and estimated 1976.
     9     Section 8.  The Pennsylvania State University shall report
    10  its revenues and expenditures and present its financial
    11  statements required under the provisions of this act in
    12  accordance with generally accepted accounting principles and
    13  procedures for educational institutions as set forth in
    14  "Industry Audit Guide for Colleges and Universities" of the
    15  American Institute of Certified Public Accountants of 1973,
    16  without exception.
    17     Section 9.  This act shall take effect immediately.
