                                  A SUPPLEMENT

     1  To the act of April 1, 1863 (P.L.213, No.227), entitled "An act
     2     to accept the grant of Public Lands, by the United States, to
     3     the several states, for the endowment of Agricultural
     4     Colleges," making appropriations for carrying the same into
     5     effect, providing for a basis for payments of such
     6     appropriations and providing a method of accounting for the
     7     funds appropriated.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  In order to carry into effect the act of
    11  Congress, approved July 2, 1862, granting public land to the
    12  several states for educational purposes, and subsequent acts of
    13  Congress related thereto, and the act of the General Assembly of
    14  Pennsylvania accepting the provisions and conditions of said
    15  acts of Congress and pledging the faith of the State to carry
    16  the same into effect, the following sums or as much thereof as
    17  may be necessary are hereby specifically appropriated to the
    18  Trustees of the Pennsylvania State University for the fiscal
    19  year July 1, 1975 to June 30, 1976, for the purposes and in the
    20  amounts as shown:
    21     (1)  For net cost of instruction excluding                     <--

    10     Section 2.  Payments to Pennsylvania State University on
    11  account of the appropriations for all items as provided in
    12  section 1 except for instruction - Doctor of Medicine shall be
    13  made on the basis of net costs during the fiscal year.            <--
    14     Payments for instruction - Doctor of Medicine shall be made
    15  on the basis of full-time equivalent students enrollment at the
    16  rate of $7,465 per student.
    17     Section 3.  If necessary, the Pennsylvania State University
    18  may transfer funds among the appropriations listed in section 1,
    19  clauses (1), (2), (3) and (4): Provided, That the aggregate
    20  amount transferred into or out of each appropriation during the
    21  fiscal year shall not exceed 5% of the amount specifically
    22  appropriated for that purpose.
    23     Section 4.  There shall be no further disbursement of funds    <--
    24  appropriated for the Pennsylvania State University after
    25  September 30, 1975, until the chairpersons of the House and
    26  Senate Appropriations Committees and the chairpersons of the
    27  House and Senate Education Committees have received copies of
    28  letters notifying at least a 5% reduction of the current full-
    29  time faculty members or full-time equivalent faculty members and
    30  at least a 5% reduction of the current administrators and one

     1  vice-president at the university as of September 1, 1976. When
     2  the chairpersons of the respective committees have received
     3  proof of retrenchment notification they shall then notify the
     4  Treasurer of the Commonwealth who may authorize disbursements
     5  from appropriated funds to the university.
     6     As an additional condition precedent to the disbursement of
     7  appropriated funds after September 30, 1975 to the university,
     8  the university shall furnish satisfactory evidence to the
     9  chairpersons of the House and Senate Appropriations Committees
    10  and the chairpersons of the House and Senate Education
    11  Committees that, commencing with the academic year that begins
    12  in September 1975, all programs of academic fee remission and
    13  tuition waiver for all employees of the university are
    14  abolished.
    15     Section 5. 4.  Payments to the Pennsylvania State University   <--
    16  of the appropriations herein provided shall be made monthly
    17  during the fiscal year.
    18     Such monthly payments shall be made in accordance with the
    19  provisions of sections 2 and 3, on the basis of estimated net     <--
    20  costs and full-time equivalent students enrolled in the Doctor
    21  of Medicine program. The estimate of net costs shall be           <--
    22  submitted by the Pennsylvania State University to the Secretary
    23  of Education, the General Assembly and to the State Treasurer
    24  not later than 30 days prior to the date on which such payment
    25  is to be made.
    26     Section 6. 5.  The Pennsylvania State University shall apply   <--
    27  the moneys appropriated by this act only for such purposes as
    28  are permitted in this act and shall at all times maintain proper
    29  records showing the application of such moneys. Not later than
    30  120 days after the close of the fiscal year to which this act

     1  relates, the Pennsylvania State University shall file with the
     2  Secretary of Education, the General Assembly, and with the
     3  Auditor General of the Commonwealth, a statement setting forth
     4  the amounts and purposes of all expenditures made from moneys
     5  appropriated by this act and other university accounts during
     6  said fiscal year, the number of full-time equivalent students
     7  enrolled in the Doctor of Medicine program and net costs, as      <--
     8  provided in sections 2 and 3, used as a basis for receipt of any
     9  appropriation during said fiscal year.
    10     Such statement of expenditures and number of full-time
    11  equivalent students enrolled in the Doctor of Medicine program
    12  and net costs shall be reviewed by the Auditor General of the     <--
    13  Commonwealth, and he shall have the right, in respect to the
    14  moneys appropriated by this act, to audit and disallow
    15  expenditures made for purposes not permitted by this act and to
    16  cause such sums to be recovered and paid by the Pennsylvania
    17  State University to the Treasurer of the Commonwealth. The
    18  Auditor General shall also make a determination of full-time
    19  equivalent students enrolled in the Doctor of Medicine program
    20  and net costs and make a certification as to their correctness.   <--
    21  In respect to expenditures made by the university from moneys
    22  other than those appropriated by this act, the Auditor General
    23  shall have the right to review only and he shall file annually
    24  with the General Assembly such information concerning such
    25  expenditures as the General Assembly or any of its committees
    26  may require.
    27     Section 7. 6.  A report shall be submitted to the Governor     <--
    28  and the Appropriations and Education Committees of the Senate
    29  and House of Representatives and shall include data for all
    30  programs of the university except the Doctor of Medicine

     1  program. The report, to be submitted prior to November 1, 1976,
     2  shall cover the twelve-month period beginning September 1, 1975.
     3  The report shall include for each term during the period:
     4     (1)  The following counts and distributions:
     5     (i)  The definitions and numbers of full-time faculty
     6  members, of part-time faculty members, of full-time students
     7  enrolled in graduate courses, of full-time students enrolled in
     8  undergraduate courses, of part-time students enrolled in
     9  graduate courses, and of part-time students enrolled in
    10  undergraduate courses.
    11     (ii)  A distribution of part-time faculty members by the
    12  percentage of full-time employment.
    13     (iii)  Total numbers of undergraduate student credit hours,
    14  divided into lower division and upper division levels, and of
    15  graduate student credit hours divided into three levels--
    16  master's, first professional and doctoral.
    17     (iv)  Number of different courses scheduled by level of
    18  instruction, distributed by the number of sections scheduled in
    19  each course and the sections distributed by the number of
    20  students enrolled in each section.
    21     (v)  Number of terms scheduled and the dates thereof.
    22     (2)  A classification of faculty members or other
    23  professional employees by title including: professor, associate
    24  professor, assistant professor, instructor, lecturer, research
    25  associate, librarian, and academic administrator; faculty
    26  members or other professional employees under each title to be
    27  subdivided by type of assignment: undergraduate courses only,
    28  graduate courses only, or both graduate and undergraduate
    29  courses; and each such set of faculty members or other
    30  professional employees to be further subdivided by type of

     1  employment: full-time or part-time; and the following aggregates
     2  for each such subdivided classification:
     3     (i)  The number.
     4     (ii)  The sum of credits assigned to undergraduate courses
     5  and the sum of credits assigned to graduate courses taught,
     6  divided into lower division, upper division, master's, first
     7  professional and doctoral levels.
     8     (iii)  The sum of undergraduate student credit hours and the
     9  sum of graduate student credit hours generated; divided into
    10  lower division, upper division, master's, first professional and
    11  doctoral levels.
    12     (iv)  Total salary paid.
    13     (v)  Total salary paid from university funds.
    14     (vi)  Total salary paid from Federal funds.
    15     (vii)  Total salary paid from other funds.
    16     (3)  For each term of the period covered for each full-time
    17  faculty member identified by school, department and title:
    18     (i)  An analysis of the average hours per week spent in
    19  university-related activities, stating specifically hours spent
    20  in undergraduate classroom contact and graduate classroom
    21  contact, hours spent in preparation, hours spent in research and
    22  hours spent in public service.
    23     (ii)  The total salary paid and the salary paid from
    24  university funds.
    25     Section 8. 7.  In addition to the requirements of section 7    <--
    26  6, the report covering the twelve-month period beginning
    27  September 1, 1975, shall include for all programs of the
    28  university except the Doctor of Medicine program:
    29     (1)  Minimum number of credits required for a baccalaureate
    30  degree, and for a master's degree.

     1     (2)  Number of bachelor's degrees, master's degrees, first
     2  professional degrees, and doctoral degrees awarded in 1973, 1974
     3  and 1975 and estimated 1976.
     4     Section 9. 8.  The Pennsylvania State University shall report  <--
     5  its revenues and expenditures and present its financial
     6  statements required under the provisions of this act in
     7  accordance with generally accepted accounting principles and
     8  procedures for educational institutions as set forth in
     9  "Industry Audit Guide for Colleges and Universities" of the
    10  American Institute of Certified Public Accountants of 1973,
    11  without exception.
    12     Section 10. 9.  This act shall take effect July 1, 1975        <--
