        SENATOR CIANFRANI, APPROPRIATIONS, AS AMENDED, JUNE 30, 1975

                                  A SUPPLEMENT

     1  To the act of November 30, 1965 (P.L.843, No.355), entitled "An
     2     act providing for the establishment and operation of Temple
     3     University as an instrumentality of the Commonwealth to serve
     4     as a State-related university in the higher education system
     5     of the Commonwealth; providing for change of name; providing
     6     for the composition of the board of trustees; terms of
     7     trustees, and the power and duties of such trustees;
     8     providing for preference to Pennsylvania residents in
     9     tuition; providing for public support and capital
    10     improvements; authorizing appropriations in amounts to be
    11     fixed annually by the General Assembly; providing for the
    12     auditing of accounts of expenditures from said
    13     appropriations; authorizing the issuance of bonds exempt from
    14     taxation within the Commonwealth; requiring the President to
    15     make an annual report of the operations of Temple
    16     University," making appropriations for carrying the same into
    17     effect, providing for a basis for payments of such
    18     appropriation and providing a method of accounting for the
    19     funds appropriated.

    20     The General Assembly of the Commonwealth of Pennsylvania
    21  hereby enacts as follows:
    22     Section 1.  The following sums, or as much thereof as may be
    23  necessary, are hereby specifically appropriated to the Trustees
    24  of Temple University at Philadelphia for the fiscal year July 1,
    25  1975 to June 30, 1976, for the purposes and in the amounts as
    26  shown:
    27     (1)  For net cost of instruction excluding                     <--

     1          Doctor of Medicine
     2          FOR GENERAL INSTITUTIONAL EXPENSES.......... $55,299,000  <--
     3     (2)  For net cost of student aid.................   3,018,000
     4     (3)  For instruction - Doctor of Medicine
     5          only........................................   5,375,000
     6     (4)  FOR OPERATION OF DENTAL CLINICS IN THE                    <--
     7          SCHOOL OF DENTISTRY.........................     500,000
     8     Section 2.  Payments to Temple University on account of the
     9  appropriations for all items, as provided in section 1, except
    10  for instruction Doctor of Medicine, shall be made on the basis
    11  of net costs during the fiscal year.                              <--
    12     Payments for instruction - Doctor of Medicine only shall be
    13  made on the basis of full-time equivalent students enrolled at
    14  the rate of $7,465 per student.
    15     Section 3.  If necessary, Temple University may transfer
    16  funds among the appropriations listed in section 1, clauses (1)
    17  and (2): Provided, That the aggregate amount transferred into or
    18  out of each appropriation during the fiscal year shall not
    19  exceed 5% of the amount specifically appropriated for that
    20  purpose.
    21     Section 4.  There shall be no further disbursement of funds    <--
    22  appropriated for Temple University after September 30, 1975,
    23  until the Chairpersons of the House and Senate Appropriations
    24  Committees and the Chairpersons of the House and Senate
    25  Education Committees have received copies of letters notifying
    26  at least a 5% reduction of the current full-time faculty members
    27  or full-time equivalent faculty members, and at least a 5%
    28  reduction of the current administrators and one vice-president
    29  at the university as of September 1, 1976. When the Chairpersons
    30  of the respective committees have received proof of reduction

     1  notification they shall then notify the Treasurer of the
     2  Commonwealth who may authorize disbursements from appropriated
     3  funds to the university.
     4     As an additional condition precedent to the disbursement of
     5  appropriated funds after September 30, 1975 to the university,
     6  the university shall furnish satisfactory evidence to the
     7  Chairpersons of the House and Senate Appropriations Committees
     8  and the Chairpersons of the House and Senate Education
     9  Committees that, commencing with the academic year that begins
    10  in September 1975, all programs of academic fee remission and
    11  tuition waiver for all employees of the university are
    12  abolished.
    13     Section 5. 4.  Payment to Temple University of the             <--
    14  appropriations herein provided shall be made monthly during the
    15  fiscal year.
    16     Such monthly payments shall be made in accordance with the
    17  provisions of sections 2 and 3, on the basis of estimated net     <--
    18  costs and full-time equivalent students enrolled in the Doctor
    19  of Medicine program. The estimate of net costs shall be           <--
    20  submitted by Temple University to the Secretary of Education,
    21  the General Assembly and to the State Treasurer not later than
    22  30 days prior to the date on which such payment is to be made.
    23     Section 6. 5.  Temple University shall apply the moneys        <--
    24  appropriated by this act only for such purposes as are permitted
    25  in this act and shall at all times maintain proper records
    26  showing the application of such moneys. Not later than 120 days
    27  after the close of the fiscal year to which this act relates,
    28  Temple University shall file with the Secretary of Education,
    29  the General Assembly and with the Auditor General of the
    30  Commonwealth a statement setting forth the amounts and purposes

     1  of all expenditures made from moneys appropriated by this act
     2  and other university accounts during said fiscal year the number
     3  of full-time equivalent students enrolled in the Doctor of
     4  Medicine program and net costs, as provided in section 2, used    <--
     5  as a basis for receipt of any appropriation during said fiscal
     6  year. Such statement of expenditures, and number of full-time
     7  equivalent students enrolled in the Doctor of Medicine program
     8  and net costs shall be reviewed by the Auditor General of the     <--
     9  Commonwealth, and he shall have the right, in respect to the
    10  moneys appropriated by this act, to audit and disallow
    11  expenditures made for purposes not permitted by this act and to
    12  cause such sums to be recovered and paid by Temple University to
    13  the Treasurer of the Commonwealth. The Auditor General shall
    14  also make a determination of full-time equivalent students
    15  enrolled in the Doctor of Medicine program and net costs and      <--
    16  make certification as to their correctness. In respect to
    17  expenditures made by the university from moneys other than those
    18  appropriated by this act, the Auditor General shall have the
    19  right to review only and he shall file annually with the General
    20  Assembly such information concerning said expenditures as the
    21  General Assembly or any of its committees may require.
    22     Section 7. 6.  A report shall be submitted to the Governor     <--
    23  and the Appropriations and Education Committees of the Senate
    24  and House of Representatives and shall include data for all
    25  programs of the university except the Doctor of Medicine
    26  program. The report, to be submitted prior to November 1, 1976,
    27  shall cover the twelve-month period beginning September 1, 1975.
    28  The report shall include for each term during the period:
    29     (1)  The following counts and distributions:
    30     (i)  The definitions and numbers of full-time faculty

     1  members, of part-time faculty members, of full-time students
     2  enrolled in graduate courses, of full-time students enrolled in
     3  undergraduate courses, of part-time students enrolled in
     4  graduate courses, and of part-time students enrolled in
     5  undergraduate courses.
     6     (ii)  A distribution of part-time faculty members by the
     7  percentage of full-time employment.
     8     (iii)  Total numbers of undergraduate student credit hours,
     9  divided into lower division and upper division levels, and of
    10  graduate student credit hours divided into three levels --
    11  master's, first professional and doctoral.
    12     (iv)  Number of different courses scheduled by level of
    13  instruction, distributed by the number of sections scheduled in
    14  each course and the sections distributed by the number of
    15  students enrolled in each section.
    16     (v)  Number of terms scheduled and the dates thereof.
    17     (2)  A classification of faculty members or other
    18  professional employees by title including: professor, associate
    19  professor, assistant professor, instructor, lecturer, research
    20  associate, librarian, and academic administrator; faculty
    21  members or other professional employees under each title to be
    22  subdivided by type of assignment: undergraduate courses only,
    23  graduate courses only, or both graduate and undergraduate
    24  courses; and each such set of faculty members or other
    25  professional employees to be further subdivided by type of
    26  employment: full-time or part-time; and the following aggregates
    27  for each such subdivided classification:
    28     (i)  The number.
    29     (ii)  The sum of credits assigned to undergraduate courses
    30  and the sum of credits assigned to graduate courses taught,

     1  divided into lower division, upper division, master's, first
     2  professional and doctoral levels.
     3     (iii)  The sum of undergraduate student credit hours and the
     4  sum of graduate student credit hours generated; divided into
     5  lower division, upper division, master's, first professional and
     6  doctoral levels.
     7     (iv)  Total salary paid.
     8     (v)  Total salary paid from university funds.
     9     (vi)  Total salary paid from Federal funds.
    10     (vii)  Total salary paid from other funds.
    11     (3)  For each term of the period covered for each full-time
    12  faculty member identified by school, department and title:
    13     (i)  An analysis of the average hours per week spent in
    14  university-related activities, stating specifically hours spent
    15  in undergraduate classroom contact and graduate classroom
    16  contact, hours spent in preparation, hours spent in research and
    17  hours spent in public service.
    18     (ii)  The total salary paid and the salary paid from
    19  university funds.
    20     Section 8. 7.  In addition to the requirements of section 7    <--
    21  6, the report covering the twelve-month period beginning
    22  September 1, 1975, shall include for all programs of the
    23  university except the Doctor of Medicine program:
    24     (1)  Minimum number of credits required for a baccalaureate
    25  degree, and for a master's degree.
    26     (2)  Number of bachelor's degrees, master's degrees, first
    27  professional degrees, and doctoral degrees awarded in 1973, 1974
    28  and 1975 and estimated 1976.
    29     Section 9. 8.  The university shall report its revenues and    <--
    30  expenditures and present its financial statements required under

     1  the provisions of this act in accordance with generally accepted
     2  accounting principles and procedures for educational
     3  institutions as set forth in "The Industry Audit Guide for
     4  Colleges and Universities" of the American Institute of
     5  Certified Public Accountants of 1973, without exception.
     6     Section 10. 9.  This act shall take effect July 1, 1975        <--
