A SUPPLEMENT 1 To the act of July 28, 1966 (3rd Sp.Sess., P.L.87, No.3), 2 entitled "An act providing for the establishment and 3 operation of the University of Pittsburgh as an 4 instrumentality of the Commonwealth to serve as a State- 5 related university in the higher education system of the 6 Commonwealth; providing for change of name; providing for the 7 composition of the board of trustees; terms of trustees, and 8 the power and duties of such trustees; authorizing 9 appropriations in amounts to be fixed annually by the General 10 Assembly; providing for the auditing of accounts of 11 expenditures from said appropriations; providing for public 12 support and capital improvements; authorizing the issuance of 13 bonds exempt from taxation within the Commonwealth; requiring 14 the chancellor to make an annual report of the operations of 15 the University of Pittsburgh," making appropriations for 16 carrying the same into effect, providing for a basis for 17 payments of such appropriations, and providing a method of 18 accounting for the funds appropriated. 19 The General Assembly of the Commonwealth of Pennsylvania 20 hereby enacts as follows: 21 Section 1. The following sums, or as much thereof as may be 22 necessary, are hereby specifically appropriated to the Trustees 23 of the University of Pittsburgh for the fiscal year July 1, 1975 24 to June 30, 1976, for the purpose and in the amounts as shown: 25 (1) For net cost of instruction excluding <-- 26 Doctor of Medicine GENERAL INSTITUTIONAL <--
1 EXPENSES .................................. $51,292,000 2 (2) For net cost of student aid................. 2,960,000 3 (3) For instruction - Doctor of Medicine 4 only........................................ 3,986,000 5 (4) FOR OPERATION OF DENTAL CLINICS IN THE <-- 6 SCHOOL OF DENTAL MEDICINE .............. 500,000 7 Section 2. Payments to the University of Pittsburgh on 8 account of the appropriations for all items, as provided in 9 section 1 except for instruction - Doctor of Medicine shall be 10 made on the basis of net costs during the fiscal year. <-- 11 Payments for instruction - Doctor of Medicine shall be made 12 on the basis of full-time equivalent student enrollment at the 13 rate of $7,465 per student. 14 Section 3. If necessary the University of Pittsburgh may 15 transfer funds between the appropriations listed in section 1, 16 clauses (1) and (2): Provided, That the aggregate amount 17 transferred into or out of each appropriation during the fiscal 18 year shall not exceed 5% of the amount specifically appropriated 19 for that purpose. 20 Section 4. There shall be no further disbursement of funds <-- 21 appropriated for the University of Pittsburgh after September 22 30, 1975, until the chairpersons of the House and Senate 23 Appropriations Committees and the chairpersons of the House and 24 Senate Education Committees have received copies of letters 25 notifying at least a 5% reduction of the current full-time 26 faculty members or full-time equivalent faculty members, and at 27 least a 5% reduction of the current administrators and one vice- 28 president at the university as of September 1, 1976. When the 29 chairpersons of the respective committees have received proof of 30 reduction notification they shall then notify the Treasurer of 19750S0769B1007 - 2 -
1 the Commonwealth who may authorize disbursements from 2 appropriated funds to the university. 3 As an additional condition precedent to the disbursement of 4 appropriated funds after September 30, 1975 to the university, 5 the university shall furnish satisfactory evidence to the 6 chairpersons of the House and Senate Appropriations Committees 7 and the chairpersons of the House and Senate Education 8 Committees that, commencing with the academic year that begins 9 in September 1975, all programs of academic fee remission and 10 tuition waiver for all employees of the university are 11 abolished. 12 Section 5 4. Payments to the University of Pittsburgh of the <-- 13 appropriations herein provided shall be made monthly during the 14 fiscal year. 15 Such monthly payments shall be made in accordance with the 16 provisions of section 2 on the basis of estimated net costs and <-- 17 full-time equivalent students enrolled in the Doctor of Medicine 18 program. The estimate of net costs shall be submitted by the <-- 19 University of Pittsburgh to the Secretary of Education, the 20 General Assembly and to the Treasurer of the Commonwealth not 21 later than 30 days prior to the date on which such payment is to 22 be made. 23 Section 6 5. The University of Pittsburgh shall apply the <-- 24 moneys appropriated by this act only for such purposes as are 25 permitted in this act and shall at all times maintain proper 26 records showing the application of such moneys. Not later than 27 120 days after the close of the fiscal year to which this act 28 relates, the University of Pittsburgh shall file with the 29 Secretary of Education, the General Assembly and with the 30 Auditor General of the Commonwealth, a statement setting forth 19750S0769B1007 - 3 -
1 the amounts and purposes of all expenditures made from moneys 2 appropriated by this act and other university accounts during 3 said fiscal year, the number of full-time equivalent students 4 enrolled in the Doctor of Medicine program and net costs, as <-- 5 provided in section 2, used as a basis for receipt of any 6 appropriation during said fiscal year. 7 Such statement of expenditures, and number of full-time 8 equivalent students enrolled in the Doctor of Medicine program 9 and net costs shall be reviewed by the Auditor General of the <-- 10 Commonwealth, and he shall have the right, in respect to the 11 moneys appropriated by this act, to audit and disallow 12 expenditures made for purposes not permitted by this act and to 13 cause such sums to be recovered and paid by the University of 14 Pittsburgh to the Treasurer of the Commonwealth. The Auditor 15 General shall also make a determination of full-time equivalent 16 students enrolled in the Doctor of Medicine program and net <-- 17 costs and make a certification as to their correctness. In 18 respect to expenditures made by the university from moneys other 19 than those appropriated by this act, the Auditor General shall 20 have the right to review only and he shall file annually with 21 the General Assembly such information concerning such 22 expenditures as the General Assembly or any of its committees 23 may require. 24 Section 7 6. A report shall be submitted to the Governor and <-- 25 the Appropriations and Education Committees of the Senate and 26 House of Representatives and shall include data for all programs 27 of the university except the Doctor of Medicine program. The 28 report, to be submitted prior to November 1, 1976, shall cover 29 the twelve-month period beginning September 1, 1975. 1 (1) The following counts and distributions: 2 (i) The definitions and numbers of full-time faculty 3 members, of part-time faculty members, of full-time students 4 enrolled in graduate courses, of full-time students enrolled in 5 undergraduate courses, of part-time students enrolled in 6 graduate courses, and of part-time students enrolled in 7 undergraduate courses. 8 (ii) A distribution of part-time faculty members by the 9 percentage of full-time employment. 10 (iii) Total numbers of undergraduate student credit hours, 11 divided into lower division and upper division levels, and of 12 graduate student credit hours divided into three levels-- 13 master's, first professional and doctoral. 14 (iv) Number of different courses scheduled by level of 15 instruction, distributed by the number of sections scheduled in 16 each course and the sections distributed by the number of 17 students enrolled in each section. 18 (v) Number of terms scheduled and the dates thereof. 19 (2) A classification of faculty members or other 20 professional employees by title including: professor, associate 21 professor, assistant professor, instructor, lecturer, research 22 associate, librarian, and academic administrator; faculty 23 members or other professional employees under each title to be 24 subdivided by type of assignment: undergraduate courses only, 25 graduate courses only, or both graduate and undergraduate 26 courses; and each such set of faculty members or other 27 professional employees to be further subdivided by type of 28 employment: full-time or part-time; and the following aggregates 29 for each such subdivided classification: 30 (i) The number. 19750S0769B1007 - 5 -
1 (ii) The sum of credits assigned to undergraduate courses 2 and the sum of credits assigned to graduate courses taught, 3 divided into lower division, upper division, master's, first 4 professional and doctoral levels. 5 (iii) The sum of undergraduate student credit hours and the 6 sum of graduate student credit hours generated; divided into 7 lower division, upper division, master's, first professional and 8 doctoral levels. 9 (iv) Total salary paid. 10 (v) Total salary paid from university funds. 11 (vi) Total salary paid from Federal funds. 12 (vii) Total salary paid from other funds. 13 (3) For each term of the period covered for each full-time 14 faculty member identified by school, department and title: 15 (i) An analysis of the average hours per week spent in 16 university-related activities, stating specifically hours spent 17 in undergraduate classroom contact and graduate classroom 18 contact, hours spent in preparation, hours spent in research and 19 hours spent in public service. 20 (ii) The total salary paid and the salary paid from 21 university funds. 22 Section 8 7. In addition to the requirements of section 7 6, <-- 23 the report covering the twelve-month period beginning September 24 1, 1975, shall include for all programs of the university except 25 the Doctor of Medicine program: 26 (1) Minimum number of credits required for a baccalaureate 27 degree, and for a master's degree. 28 (2) Number of bachelor's degrees, master's degrees, first 29 professional degrees, and doctoral degrees awarded in 1973, 1974 30 and 1975 and estimated 1976. 19750S0769B1007 - 6 -
1 Section 9 8. The university shall report its revenues and <-- 2 expenditures and present its financial statements required under 3 the provisions of this act in accordance with generally accepted 4 accounting principles and procedures for educational 5 institutions as set forth in "Industry Audit Guide for Colleges 6 and Universities" of the American Institute of Certified Public 7 Accountants of 1973, without exception. 8 Section 10 9.
