AN ACT
1 Authorizing the Borough of Shamokin Dam to transfer certain
2 Project 70 lands in Snyder County to the Department of
3 Transportation for a highway project under certain
4 conditions.
5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. Pursuant to the requirements of subsection (b) of
8 section 20, act of June 22, 1964 (P.L.131, No.8), known as the
9 "Project 70 Land Acquisition and Borrowing Act," the General
10 Assembly authorizes the Borough of Shamokin Dam to transfer the
11 hereinafter described land in the Borough of Shamokin Dam in
12 Snyder County to the Department of Transportation for right-of-
13 way for construction of Highway Project, L.R. 1083, Section A10.
14 Such land shall be free of the restrictions on use and
15 alienation prescribed by section 20 of the act of June 22, 1964
16 (P.L.131, No.8), known as the "Project 70 Land Acquisition and
17 Borrowing Act," upon:
18 (1) Payment to the Borough in an amount equal to the fair
1 market value of the land transferred AS DETERMINED BY THE <--
2 DEPARTMENT OF TRANSPORTATION BASED ON APPRAISALS OF TWO
3 QUALIFIED REAL ESTATE APPRAISERS; and
4 (2) Execution and filing of a document of transfer and
5 release, citing such payment or acquisition, transfer and
6 release of the said land from the restrictions on use and
7 alienation prescribed by subsection (b) of section 20 of said
8 act.
9 The document of transfer and release in such cases shall,
10 upon such reimbursement or acquisition, be approved by the
11 Department of Justice and filed in the office of the Recorder of
12 Deeds of the county in which the said land is located.
13 Compliance with this subsection constitutes the express approval
14 of the General Assembly of release of the restrictions on use
15 and alienation of lands acquired by the Department of
16 Transportation required by subsection (b) of section 20 of said
17 act.
18 Section 2. The land to be transferred by the Borough of
19 Shamokin Dam to the Department of Transportation for right-of-
20 way for construction of Highway Project, L.R. 1083, Section A10,
21 is more particularly described as follows:
22 Description of Highway Project
23 Project L.R.1083, Section A10 in the Borough of Shamokin Dam,
24 Snyder County approximately 2,800 feet west of the intersection
25 of L.R. 25 and Fifth Street. Continuing, the line crosses L.R.
26 25, (U.S. Rts. 11 and 15), L.R. 54067, the Reading Company
27 railroad, the Susquehanna River and L.R. 1 (Front Street),
28 terminating at a point approximately 100 feet east of L.R. 1 in
29 the City of Sunbury, Northumberland County, a distance of
30 approximately 1.2 miles.

1 Description of Required Project 70 Land
2 The Project 70 land required for this project comprises
3 approximately 1.39 acres, located approximately as follows:
4 (1) Between Stations 70+85 and 74+47 on L.R. 1083 Eastbound
5 and Westbound Baseline.
6 (2) Between Stations 70+66 and 74+45 on Ramp F.
7 (3) Between Stations 75+84 and 79+23 on Ramp J.
8 The highway right-of-way will have a maximum width of 220
9 feet, more or less and estate to be acquired is limited to an
10 aerial easement plus a surface easement unlimited in vertical
11 dimension for the accommodation of piers and other
12 appurtenances.
13 Section 3. This act shall take effect immediately.
