                                     AN ACT

     1  Amending the act of August 14, 1963 (P.L.984, No.450), entitled
     2     "An act to increase the commerce and prosperity of the people
     3     of the Commonwealth, to improve their health and living
     4     conditions, and to alleviate the problems created by traffic
     5     congestion and the existence of inadequate mass
     6     transportation facilities, by authorizing the creation of a
     7     transportation authority to function in each metropolitan
     8     area consisting of any county of the first class and all
     9     nearby counties within a radius of twenty (20) miles of any
    10     such first class county, as a body corporate and politic for
    11     the purpose of establishing an integrated mass transportation
    12     system with all pertinent powers including, but not limited
    13     to, leasing, acquiring, owning, operating and maintaining a
    14     system for, or otherwise providing for, the transportation of
    15     persons, authorizing the borrowing of money and issuance of
    16     bonds therefor, conferring the right of eminent domain on the
    17     authority; altering the jurisdiction of the Public Utility
    18     Commission, authorizing the acceptance of grants from
    19     Federal, State and local governments, limiting actions
    20     against the authority and exempting it from taxation,
    21     authorizing counties and municipalities to enter into
    22     compacts for the financing of each authority and to make
    23     appropriations in accordance with such compacts, conferring
    24     exclusive jurisdiction upon certain courts with respect to
    25     matters relating to such authority, and empowering each
    26     authority to function outside of the metropolitan area under
    27     certain terms and conditions," further providing for the
    28     membership of the board.

    29     The General Assembly of the Commonwealth of Pennsylvania
    30  hereby enacts as follows:
    31     Section 1.  Section 16, act of August 14, 1963 (P.L.984,

     1  No.450), known as the "Metropolitan Transportation Authorities
     2  Act of 1963," is amended to read:
     3     Section 16.  Appointment of Board Members.--
     4     (a)  At any time after the effective date of this act,
     5     (1)  The Governor may appoint as a member of the board, one
     6  person, who may be an ex-officio appointee from among the
     7  various officials in the government of the Commonwealth, and
     8  whose term as a board member shall run concurrently with that of
     9  his Commonwealth position, if any, or the term of the appointing
    10  Governor, whichever is shorter.
    11     (2)  The county commissioners in each county, [and, in any
    12  county of the first class containing a city of the first class,
    13  the mayor, with the approval of the city council,] except in
    14  counties of the first class, may appoint two (2) persons for
    15  each county to serve as board members, for staggered initial
    16  terms, two of which terms, but not two from the same county,
    17  shall expire on the first day of September, beginning in 1964
    18  and continuing until all initial terms shall have expired. In
    19  any county of the first class containing a city of the first
    20  class, the mayor, with the approval of the city council, may
    21  appoint three (3) persons to serve as board members. Specific
    22  expiration dates for the several terms shall be apportioned
    23  among the counties in such manner as shall be agreed upon by the
    24  appointing powers.
    25     (3)  The Speaker of the House of Representatives shall
    26  appoint two (2) members of the House of Representatives, one(1)
    27  from the majority party and one (1) from the minority party, to
    28  serve as board members. The President pro tempore of the Senate
    29  shall appoint two (2) members of the Senate, one (1) from the
    30  majority party and one (1) from the minority party, to serve as

     1  board members. The members appointed by the Speaker of the House
     2  of Representatives and the President pro tempore of the Senate
     3  shall serve at the pleasure of their respective appointing
     4  authorities.
     5     (b)  At the expiration of the term of any board member, his
     6  successor shall be appointed by the same power who appointed
     7  him, for a term of five (5) years from such expiration date
     8  except in the case of the board members who are appointed
     9  pursuant to subsection (a)(3), who shall serve as provided
    10  therein.
    11     (c)  The appointing powers shall certify their respective
    12  appointments, whether initial or subsequent, to the Secretary of
    13  the Commonwealth. Within thirty (30) days after certification of
    14  his appointment and before entering upon the duties of his
    15  office, each member of the board shall take and subscribe the
    16  constitutional oath of office and file it in the office of the
    17  Secretary of the Commonwealth.
    18     Section 2.  This act shall take effect immediately.
