AN ACT
1 Providing job protection for certain part-time police officers
2 and providing for certain civil damages.
3 The General Assembly of the Commonwealth of Pennsylvania
4 hereby enacts as follows:
5 Section 1. No individual who serves as a part-time police
6 officer in a municipality of this Commonwealth and who also
7 holds a full-time position with another employer shall be
8 subject to dismissal for absenteeism by the full-time employer
9 when such individual is required, as a police officer, to appear
10 at a judicial proceeding as a prosecuting officer or is
11 subpoenaed to appear as a witness.
12 Section 2. Any employee who is dismissed contrary to the
13 provisions of section 1 may sue the full-time employer in a
14 civil action and shall be entitled to be reinstated in the same
15 position at the same wage scale as before dismissal and shall be
16 entitled to recover three times the total of the lost wages and
17 benefits as a result of the dismissal and all necessary
18 attorney's fees for proceeding with the action.
1 Section 3. This act shall take effect January 1, 1977.
