AN ACT
1 Amending the act of October 20, 1966 (3rd Sp.Sess., P.L.96,
2 No.6), entitled "An act relating to mental health and mental
3 retardation; authorizing county programs and amending,
4 revising and changing the laws relating thereto and making an
5 appropriation," providing for care and services to certain
6 persons.
7 The General Assembly of the Commonwealth of Pennsylvania
8 hereby enacts as follows:
9 Section 1. Subsection (d) of section 301, act of October 20,
10 1966 (3rd Sp.Sess., P.L.96, No.6), known as the "Mental Health
11 and Mental Retardation Act of 1966," is amended by adding
12 clauses to read:
13 Section 301. General Powers and Duties of Local Authorities;
14 Mental Health and Mental Retardation Program and Services.--

16 (d) Subject to the provisions of sections 508 and 509 (5) it
17 shall be the duty of local authorities in cooperation with the
18 department to insure that the following mental health and mental
19 retardation services are available:

1 (10) Protective custody for a maximum of seventy-two hours
2 for any adult or child who was forced from his or her residence
3 as a result of physical violence or a threat thereof.
4 (11) Counseling services to any person seeking help
5 regarding problems arising out of physical violence or abuse or
6 providing such services to any person by court order.
7 Section 2. This act shall take effect immediately.
