                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," providing for a referendum on the
     6     school budget.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  The act of March 10, 1949 (P.L.30, No.14), known
    10  as the "Public School Code of 1949," is amended by adding a
    11  subdivision to read:
    12                      (g)  Budget Referendum.
    13     Section 696.  Referendum.--At the primary or general election
    14  immediately preceding the next fiscal year of the school
    15  district, the board of school directors shall determine the will
    16  of the electorate with respect to the adoption of the school
    17  budget for the next fiscal year.
    18     The question shall be in substantially the following form:



     1     Do you favor the proposed               Yes
     2     school budget for the fiscal
     3     year 19____ to 19____?                  No
     4     In case of a tie vote or if a majority of the electors voting
     5  on the question vote "yes," the board of school directors may
     6  adopt the budget. If a majority vote "no," the board shall not
     7  have power to adopt a final budget, but shall, at least monthly,
     8  submit a budget to the electorate in special elections until a
     9  "yes" vote is obtained.
    10     The budget finally adopted shall not, during the fiscal year,
    11  exceed the total sum in the budget submitted to and receiving
    12  the affirmative vote of the electors.
    13     The board of school directors shall submit the school budget
    14  to the county board of elections at least sixty (60) days before
    15  the primary or general election preceding the next fiscal year
    16  of the school district.
    17     Section 2.  This act shall take effect immediately.
