                                     AN ACT

     1  Amending the act of December 10, 1974 (P.L.852, No.287),
     2     entitled "An act to protect the public health and safety by
     3     preventing excavation or demolition work from damaging
     4     underground lines used in providing electricity,
     5     communication, gas, oil delivery, oil product delivery,
     6     sewage, water or other service; imposing duties upon the
     7     providers of such service, recorders of deeds, and persons
     8     and other entities preparing drawings or performing
     9     excavation or demolition work; and prescribing penalties,"
    10     providing an exception to certain requirements under the act.

    11     The General Assembly of the Commonwealth of Pennsylvania
    12  hereby enacts as follows:
    13     Section 1.  The act of December 10, 1974 (P.L.852, No.287),
    14  entitled "An act to protect the public health and safety by
    15  preventing excavation or demolition work from damaging
    16  underground lines used in providing electricity, communication,
    17  gas, oil delivery, oil product delivery, sewage, water or other
    18  service; imposing duties upon the providers of such service,
    19  recorders of deeds, and persons and other entities preparing
    20  drawings or performing excavation or demolition work; and
    21  prescribing penalties," is amended by adding a section to read:
    22     Section 5.1.  The duties imposed by this act upon designers


     1  and contractors shall not apply when the owner of the real
     2  property on which the excavation or demolition is to take place
     3  has determined by a thorough search of the records in the
     4  appropriate recorder of deeds' office that there are no user's
     5  lines recorded as crossing said owner's property.
     6     Section 2.  This act shall take effect immediately.
