                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," further providing for Commonwealth
     6     reimbursements.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Clause (12) of section 2501 and subsection (d) of
    10  section 2502, act of March 10, 1949 (P.L.30, No.14), known as
    11  the "Public School Code of 1949," amended June 26, 1974
    12  (P.L.370, No.125), are amended to read:
    13     Section 2501.  Definitions.--For the purposes of this article
    14  the following terms shall have the following meanings:

    16     (12)  "State's Share of Total Cost." For the school year
    17  1966-1967 and each school year thereafter, the State's share of
    18  total reimbursable cost shall be fifty percent (50%). Total
    19  reimbursable cost shall be the lesser of actual expense per WADM
    20  as defined in clause (11.1) or a maximum amount to be fixed by

     1  the General Assembly from time to time to represent the
     2  estimated average actual expense per WADM in the year for which
     3  the reimbursement is to be payable. For the school year
     4  commencing the first day of July 1973 and each school year
     5  thereafter through July 1, 1975 the maximum amount shall be
     6  seven hundred fifty dollars ($750); but for reimbursement for
     7  instruction costs during any school year beginning with the
     8  school year July 1, 1976 and thereafter, a district shall
     9  receive a subsidy not exceeding the previous year's average
    10  Commonwealth instruction expense per WADM. The Secretary of
    11  Education annually shall calculate the State average "actual
    12  instruction expense per weighted average daily membership" and
    13  shall supply the same to the General Assembly to assist the
    14  General Assembly in evaluating the adequacy of such maximum
    15  amount.

    17     Section 2502.  Payments on Account of Instruction.--

    19     (d)  For the school year commencing the first day of July
    20  within the year of the effective date of this amendment and each
    21  school year thereafter, each school district shall be paid by
    22  the Commonwealth on account of instruction of the district's
    23  pupils an amount to be determined by multiplying the aid ratio
    24  times the actual instruction expense per weighted average daily
    25  membership or by five hundred fifty dollars ($550), whichever is
    26  less, and by the weighted average daily membership for the
    27  district. For the school year 1973-1974 and each school year
    28  thereafter through July 1, 1975 each school district shall be
    29  paid by the Commonwealth on account of instruction of the
    30  district's pupils an amount to be determined by multiplying the

     1  aid ratio times the actual instruction expense per weighted
     2  average daily membership or by seven hundred fifty dollars
     3  ($750), whichever is less; but for reimbursement for instruction
     4  costs during any school year beginning with the school year July
     5  1, 1976 and thereafter, a district shall receive a subsidy not
     6  exceeding the previous year's average Commonwealth instruction
     7  expense per WADM.
