                                     AN ACT

     1  Amending the act of June 3, 1937 (P.L.1225, No.316), entitled
     2     "An act concerning game and other wild birds and wild
     3     animals; and amending, revising, consolidating, and changing
     4     the law relating thereto," providing for a committee to issue
     5     antlerless deer licenses.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  The first paragraph of subsection (c) of section
     9  501, act of June 3, 1937 (P.L.1225, No.316), known as "The Game
    10  Law," amended June 27, 1973 (P.L.83, No.36),  is amended to
    11  read:
    12     Section 501.  Open Seasons.--* * *
    13     (c)  Resident, Nonresident, and Alien Hunters' Licenses and
    14  Tags for Antlerless Deer.--If in any year the commission, by
    15  resolution, declares an open season for antlerless deer, it
    16  shall issue resident, nonresident and alien hunters' licenses
    17  and tags for antlerless deer to hunt for or kill such deer, at a
    18  fee of two dollars thirty-five cents for the hunting license
    19  year beginning September 1, 1973 and three dollars thirty-five


     1  cents for the hunting license years beginning September 1, 1974
     2  and thereafter under such rules and regulations governing the
     3  issuance of such licenses and tags as it may deem necessary to
     4  limit the number of persons who may hunt for such deer in any
     5  county of the Commonwealth, provided public notice of such
     6  action is given as hereinafter required [:  And provided,
     7  however, That no]. Licenses for hunting antlerless deer shall be
     8  issued in each county by a committee of three persons who shall
     9  serve without compensation and who shall be the county
    10  treasurer, a member appointed by the majority commissioners and
    11  a member appointed by the minority commissioners. No
    12  applications for antlerless deer licenses shall be accepted by
    13  the committee before November 10, and no licenses shall be
    14  issued before November 25. No applications for antlerless deer
    15  licenses received from nonresidents and aliens shall be approved
    16  or licenses issued in advance of thirty days prior to the
    17  opening date of such antlerless deer season. Such licenses and
    18  tags shall be issued without restriction or regard to the county
    19  residence of the Pennsylvania applicant and may be issued only
    20  to holders of resident, nonresident, or alien hunting licenses
    21  [, and such licenses]. Licenses and tags shall not be
    22  transferable from one person to another nor shall they be
    23  refunded or reissued to anyone. Notwithstanding the provisions
    24  of any regulation limiting the number of licenses and tags the
    25  commission shall issue resident hunters' licenses and tags for
    26  antlerless deer to members of Armed Forces who are residents of
    27  Pennsylvania and who are on full time active duty, or to
    28  residents who were honorably discharged from the Armed Forces
    29  within sixty days of the date of the application upon
    30  substantial proof of their military status. The committee shall

     1  keep in the office of the county treasurer a ledger or list for
     2  public inspection of all recipients of licenses to hunt
     3  antlerless deer. The ledger or list shall be in numerical order
     4  and show the recipients' name, address, license or tag number
     5  and date of issuance. Any person who violates any provision of
     6  this subsection shall, upon conviction, be sentenced to pay a
     7  fine not exceeding five hundred dollars ($500) or to
     8  imprisonment not exceeding one year, or to both.
