                                     AN ACT

     1  Authorizing the Department of General Services with the approval
     2     of the Department of Public Welfare and the Governor, to
     3     convey to the County of Dauphin, 204 acres of land, more or
     4     less, situated in Susquehanna Township, Dauphin County,
     5     Commonwealth of Pennsylvania.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  The Department of General Services, with the
     9  approval of the Department of Public Welfare and the Governor,
    10  is hereby authorized and directed on behalf of the Commonwealth
    11  of Pennsylvania, to grant and convey to the County of Dauphin,
    12  the following tract of land situated in the Township of
    13  Susquehanna, County of Dauphin, and Commonwealth of
    14  Pennsylvania, bounded and described as follows:
    15     Beginning at a railroad spike in the centerline of Elmerton
    16  Avenue, said point being situate south 82 degrees 30 minutes 57
    17  seconds east 110.00 feet from a railroad spike at the
    18  intersection of the centerline of Elmerton Avenue and the
    19  centerline of Bamburger Road, thence with Elmerton Avenue the
    20  following four courses:

     1     1.  South 82 degrees 30 minutes 57 seconds east 1679.00 feet
     2  to a railroad spike,
     3     2.  North 84 degrees 13 minutes 41 seconds east 916.97 feet
     4  to a railroad spike,
     5     3.  South 78 degrees 39 minutes 46 seconds east 530.04 feet
     6  to a railroad spike,
     7     4.  North 86 degrees 26 minutes 30 seconds east 709.36 feet
     8  to a railroad spike;
     9  thence with the westerly line of an easement previously granted
    10  to the Pennsylvania Department of Transportation by the grantors
    11  herein - said easement being a 36 foot wide access to a 10,587
    12  acre tract being leased to the Pennsylvania Department of
    13  Transportation - the following five courses:
    14     1.  South 5 degrees 28 minutes 50 seconds east 212.94 feet to
    15  a point,
    16     2.  By a curve to the left radius 2882.79 feet arc length
    17  153.83 chord south 7 degrees 00 minutes 35 seconds east 153.86
    18  feet to a point,
    19     3.  South 8 degrees 32 minutes 20 seconds east 325.32 feet to
    20  a point,
    21     4.  By a curve to the right, radius 554.96 feet arc length
    22  121.88 feet - chord south 2 degrees 14 minutes 50 seconds east
    23  121.64 feet to a point,
    24     5.  South 38 degrees 39 minutes 14 seconds west. 100.00 feet
    25  to a steel I-beam;
    26  thence by lands leased to the Pennsylvania Department of
    27  Transportation by the grantors herein south 15 degrees 45
    28  minutes 08 seconds west 471.38 feet to a copper pin at lands now
    29  or late of Roy A. Hollinger,
    30  thence with lands of said Hollinger and lands of M. L. Lester

     1  north 78 degrees 39 minutes 30 seconds west 1770.27 feet to a
     2  point.
     3  thence with lands of M. L. Lester south 17 degrees 35 minutes 30
     4  seconds west 429.00 feet to a point,
     5  thence by the same south 78 degrees 24 minutes 30 seconds east
     6  229.90 feet to a point in the center of Locust Lane, thence with
     7  Locust Lane the following six courses:
     8     1.  South 37 degrees 55 minutes 27 seconds west 114.38 feet
     9  to a point,
    10     2.  South 30 degrees 33 minutes 46 seconds west 166.20 feet
    11  to a point,
    12     3.  South 61 degrees 48 minutes 24 seconds east 70.50 feet to
    13  a point,
    14     4.  South 11 degrees 29 minutes 27 seconds west 579.98 feet
    15  to a point,
    16     5.  South 30 degrees 18 minutes 42 seconds west 84.25 feet to
    17  a point,
    18     6.  South 23 degrees 18 minutes 39 seconds west 157.01 feet
    19  to a point;
    20  thence south 17 degrees 49 minutes 07 seconds west 159.61 feet
    21  to a blazed oak tree.
    22  Thence by lands of others south 70 degrees 22 minutes 25 seconds
    23  west 1028.12 feet to a point,
    24  thence south 68 degrees 39 minutes 25 seconds west 565.98 feet
    25  to a concrete monument,
    26  thence south 13 degrees 50 minutes 02 seconds west 236.39 feet
    27  to an iron pin,
    28  thence north 89 degrees 44 minutes 14 seconds east 239.82 feet
    29  to an iron pin at corner of lands of the Harrisburg School
    30  District;

     1  thence with lands of the latter, south 48 degrees 31 minutes 45
     2  seconds west 1050.00 feet to an iron pin,
     3  thence with lands of the grantor herein the following eight
     4  courses:
     5     1.  North 25 degrees 54 minutes 11 seconds west 847.71 feet
     6  to an iron pin,
     7     2.  North 21 degrees 53 minutes 37 seconds east 1781.43 feet
     8  to an iron pin,
     9     3.  South 82 degrees 12 minutes 14 seconds east 159.31 feet
    10  to an iron pin,
    11     4.  North 33 degrees 49 minutes 02 seconds east 304.95 feet
    12  to an iron pin,
    13     5.  South 82 degrees 12 minutes 14 seconds east 667.57 feet
    14  to an iron pin,
    15     6.  North 7 degrees 47 minutes 47 seconds east 242.60 feet to
    16  an iron pin,
    17     7.  North 82 degrees 12 minutes 14 seconds west 1010.92 feet
    18  to a point;
    19     8.  North 3 degrees 20 minutes 14 seconds east 1380.60 feet
    20  to the place of beginning.
    21     Containing 204.56 acres more or less of land, and being parts
    22  of the same land acquired by Pennsylvania Lunatic Hospital, in
    23  eminent domain proceedings before the Common Pleas Court of
    24  Dauphin County on November 18, 1875 at 365 January Term 1896,
    25  against lands of Margaret Oyster and May 16, 1893 at 671 June
    26  Term 1893, against lands of Napoleon K. Oyster.
    27     Subject to a sewer easement previously granted to the
    28  Susquehanna Township Authority and also an easement for a water
    29  line previously granted to the Pennsylvania State Police.
    30     It is also agreed that the parties of the first part grant

     1  and convey a right-of-way ingress and egress easement to the
     2  parties of the second part, said right-of-way easement being of
     3  a width of 36 feet and being the easement previously granted to
     4  the Pennsylvania Department of Transportation as access to the
     5  10.587 acre parcel leased to the Pennsylvania Department of
     6  Transportation.
     7     The conveyance shall be made under and subject to all other
     8  easements, servitudes and rights of others, including but not
     9  confined to streets, roadways, and rights of any telephone,
    10  telegraph, water, electric, sewer, gas or pipeline companies, as
    11  well as under and subject to any interests, estates or tenancies
    12  vested in third persons whether or not appearing of record, for
    13  any portion of the land or improvements erected thereon.
    14     Section 2.  The deed of conveyance shall contain a clause
    15  that the lands conveyed shall be used for public park,
    16  recreation and conservation purposes by the County of Dauphin
    17  and if at any time the said County of Dauphin or its successor
    18  in function conveys said property or authorizes or permits said
    19  property to be used for any purpose other than public recreation
    20  and parks purposes, the title thereto shall immediately revert
    21  to and revest in the Commonwealth of Pennsylvania.
    22     Section 3.  The deed of conveyance shall be approved by the
    23  Department of Justice and shall be executed by the Secretary of
    24  the Department of General Services in the name of the
    25  Commonwealth of Pennsylvania, with the approval of the Secretary
    26  of Public Welfare and the Governor.
    27     Section 4.  This act shall take effect immediately.
