AN ACT
1 Amending the act of July 21, 1941 (P.L.425, No.173), entitled
2 "An act to establish a system uniform throughout the
3 Commonwealth for the compensation of witnesses, regulating
4 the amount, payment and taxation as costs thereof, and
5 repealing inconsistent legislation," further providing
6 increases in witness fee and mileage.
7 The General Assembly of the Commonwealth of Pennsylvania
8 hereby enacts as follows:
9 Section 1. Section 2, act of July 21, 1941 (P.L.425,
10 No.173), entitled "An act to establish a system uniform
11 throughout the Commonwealth for the compensation of witnesses,
12 regulating the amount, payment and taxation as costs thereof,
13 and repealing inconsistent legislation," amended October 13,
14 1959 (P.L.1309, No.436), is amended to read:
15 Section 2. Every witness shall be paid at the rate of [five
16 dollars ($5) per day] the minimum wage for an eight hour day
17 during the necessary period of his attendance.
18 Section 2. Section 4 of the act, amended December 21, 1959
19 (P.L.1972, No.724), is amended to read:
20 Section 4. Every witness shall be paid mileage at the rate
1 of [seven cents (7¢)] fifteen cents (15¢) for each mile he
2 actually travels in going to such place from his place of
3 residence and returning, but not for a greater number of miles
4 than would be required for traveling by the usually-traveled
5 route between those places or the actual amount of
6 transportation, whichever is less.
7 Section 3. This act shall take effect in 60 days.
