                                     AN ACT

     1  Requiring electric, gas or water companies to give personal
     2     notice to the debtor and written notice to public health
     3     authorities before discontinuing service to a residence; and
     4     imposing duties on public health authorities.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  No electric, gas or water company shall
     8  unilaterally discontinue service to any residence until it gives
     9  personal notice to the debtor of such discontinuance.
    10     Section 2.  (a) When an electric, gas or water company
    11  unilaterally discontinues service to any residence, it shall
    12  give written notice of such discontinuance to the person or
    13  agency in charge of public health of the municipality in which
    14  the residence is located. Notice shall be given at least five
    15  days before the service is discontinued.
    16     (b)  Upon notification by an electric, gas or water company
    17  that it is discontinuing service to a residence, the person or
    18  agency in charge of public health of the municipality in which
    19  the residence is located shall send, prior to the date of

     1  discontinuance, an investigator to the residence to evaluate the
     2  situation, and shall take any action necessary to preserve the
     3  health and well being of the occupants of the residence.
     4     Section 3.  This act shall take effect in 60 days.
