AN ACT 1 Amending the act of March 31, 1937 (P.L.160, No.43), entitled 2 "An act creating a commission to be known as the Pennsylvania 3 Public Utility Commission; defining in part the powers and 4 duties of such commission; abolishing The Public Service 5 Commission of the Commonwealth of Pennsylvania, terminating 6 the terms of the members thereof, and transferring to the 7 Pennsylvania Public Utility Commission the records, employes, 8 property, and equipment of The Public Service Commission of 9 the Commonwealth of Pennsylvania; authorizing the 10 Pennsylvania Public Utility Commission to appear in and 11 complete all pending proceedings, legal or otherwise, 12 instituted before, by or against The Public Service 13 Commission of the Commonwealth of Pennsylvania; providing 14 that all certificates of public convenience, contracts, 15 orders, and rules and regulations of the latter commission 16 shall remain effective until repealed, changed or modified by 17 the Pennsylvania Public Utility Commission, and transferring 18 and appropriating to the Pennsylvania Public Utility 19 Commission any unexpended balance of any existing 20 appropriation to The Public Service Commission of the 21 Commonwealth of Pennsylvania," requiring special agents and 22 hearing examiners to be fulltime employes and placing certain 23 restrictions thereon. 24 The General Assembly of the Commonwealth of Pennsylvania 25 hereby enacts as follows: 26 Section 1. Section 8, act of March 31, 1937 (P.L.160, 27 No.43), entitled "An act creating a commission to be known as 28 the Pennsylvania Public Utility Commission; defining in part the
1 powers and duties of such commission; abolishing The Public 2 Service Commission of the Commonwealth of Pennsylvania, 3 terminating the terms of the members thereof, and transferring 4 to the Pennsylvania Public Utility Commission the records, 5 employes, property, and equipment of The Public Service 6 Commission of the Commonwealth of Pennsylvania; authorizing the 7 Pennsylvania Public Utility Commission to appear in and complete 8 all pending proceedings, legal or otherwise, instituted before, 9 by or against The Public Service Commission of the Commonwealth 10 of Pennsylvania; providing that all certificates of public 11 convenience, contracts, orders, and rules and regulations of the 12 latter commission shall remain effective until repealed, changed 13 or modified by the Pennsylvania Public Utility Commission, and 14 transferring and appropriating to the Pennsylvania Public 15 Utility Commission any unexpended balance of any existing 16 appropriation to The Public Service Commission of the 17 Commonwealth of Pennsylvania," is amended to read: 18 Section 8. The commission may authorize the chairman--(1) To 19 designate the time and place for the conducting of 20 investigations, inquiries and hearings; (2) to assign cases to a 21 commissioner or commissioners for hearing, investigation, 22 inquiry, study or other similar purposes; (3) to assign cases to 23 fulltime special agents or examiners for the taking and 24 receiving of evidence, the number of which shall be determined 25 on the basis of a forty hour per week workload. Their starting 26 salary shall be fourteen thousand dollars ($14,000) a year. None 27 shall engage in any other occupation or profession. They shall, 28 on the last day of January of each year after their assignment, 29 file with the secretary of the commission a statement of the 30 value of each of their personal assets and their sources of 19750H1825B2334 - 2 -
1 income as of the last day of the preceding year; and (4) to
2 direct and designate officers and employes of the commission to
3 make investigations, inspections, inquiries, studies and other
4 like assignments for report to the commission.
5 Section 2. This act shall take effect immediately.
