        AS REPORTED FROM COMMITTEE ON JUDICIARY, HOUSE OF
           REPRESENTATIVES, AS AMENDED, JANUARY 27, 1976

                                     AN ACT

     1  Amending the act of May 16, 1921 (P.L.579, No.262), entitled, as
     2     amended, "An act providing for the better management of the
     3     jails or county prisons in the several counties of this
     4     Commonwealth of the third, fourth, fifth classes and in
     5     certain counties of the sixth class by creating, in such
     6     counties, a board to be known by the name and style of the
     7     inspectors of the jail or county prison, with authority to
     8     appoint a warden of such prison, and by vesting in said
     9     board, and the officers appointed by it, the safe-keeping,
    10     discipline, and employment of prisoners and the government
    11     and management of said jails or county prisons," requiring
    12     certain board meetings to be held at the prison.

    13     The General Assembly of the Commonwealth of Pennsylvania
    14  hereby enacts as follows:
    15     Section 1.  Section 2, act of May 16, 1921 (P.L.579, No.262),
    16  entitled, as amended, "An act providing for the better
    17  management of the jails or county prisons in the several
    18  counties of this Commonwealth of the third, fourth, fifth
    19  classes and in certain counties of the sixth class by creating,
    20  in such counties, a board to be known by the name and style of
    21  inspectors of the jail or county prison, with authority to
    22  appoint a warden of such prison, and by vesting in said board,

     1  and the officers appointed by it, the safe-keeping, discipline,
     2  and employment of prisoners and the government and management of
     3  said jails or county prisons," reenacted October 26, 1972
     4  (P.L.1053, No.265), is amended to read:
     5     Section 2.  That, within thirty days after this act shall
     6  become effective in any county, the above-named board shall meet
     7  and organize by the election of a president and secretary. A
     8  majority of the members of said board shall constitute a quorum
     9  for the transaction of business, and all actions of said board
    10  must be by the approval of a majority of all the members of said
    11  board. The board shall meet monthly, or oftener if required, and
    12  keep regular minutes of their proceedings in a book, to be filed
    13  with the financial records of each of said counties, and shall
    14  make such rules and regulations for the government and
    15  management of the prison, and the safe-keeping, discipline, and
    16  employment of the prisoners, as may be deemed necessary. Such
    17  meetings shall be held at the prison no less than quarterly.
    18  Failure to hold such a meeting in any quarter shall invalidate    <--
    19  all board actions subsequent to the end of the quarter except
    20  actions taken at or after a meeting held at the prison. The
    21  board shall appoint a warden of the prison, who shall reside in
    22  the building. The warden, subject to the approval of the board,
    23  may appoint such deputy or deputies, assistant or assistants,
    24  keeper or keepers, as may be required in the taking care of the
    25  prison. The number and compensation of such deputies,
    26  assistants, or keepers shall be fixed by the salary board.
