                                     AN ACT

     1  Amending the act of April 29, 1959 (P.L.58, No.32), entitled "An
     2     act consolidating and revising the Vehicle Code, the Tractor
     3     Code, the Motor Vehicle Financial Responsibility Act and
     4     other acts relating to the ownership, possession and use of
     5     vehicles and tractors," adding penalties for driving during
     6     suspension or revocation of license in certain cases.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  The penalty clause as it relates to clause (6) of
    10  section 624, act of April 29, 1959 (P.L.58, No.32), known as
    11  "The Vehicle Code," clause (6) amended August 27, 1963
    12  (P.L.1353, No.533), the penalty clause amended May 26, 1972
    13  (P.L.313, No.84), is amended to read:
    14     Section 624.  Violation of License Provisions.--It shall be
    15  unlawful for any person to commit any of the following acts:

    17     (6)  To operate any motor vehicle or tractor upon the
    18  highways of this Commonwealth after the operating privilege is
    19  suspended or revoked or after the privilege, to apply for an
    20  operator's license or learner's permit is suspended and before

     1  such operating privilege or right to apply for an operator's
     2  license or learner's permit has been reinstated.

     4     Penalty.--Any person violating any of the provisions of
     5  clause (1), (2), (3) or (4) of this section, shall, upon summary
     6  conviction before a magistrate, be sentenced to pay a fine of
     7  fifty dollars ($50.00) and costs of prosecution, and, in default
     8  of the payment thereof, shall undergo imprisonment for not more
     9  than ten (10) days.
    10     Any person violating any of the provisions of clause (8) of
    11  this section, shall, upon summary conviction before a
    12  magistrate, be sentenced to pay a fine of one hundred dollars
    13  ($100.00) and costs of prosecution, and, in default of the
    14  payment thereof, shall undergo imprisonment for not more than
    15  twenty (20) days.
    16     Any person violating any of the provisions of clauses (6) or
    17  (7) of this section for the first offense, shall, upon summary
    18  conviction thereof, be sentenced to pay a fine of not less than
    19  one hundred dollars ($100.00) or more than two hundred dollars
    20  ($200.00) and costs of prosecution, or to undergo imprisonment
    21  for not more than two (2) months, or both.
    22     Any person violating any of the provisions of clause (5) of
    23  this section or clauses (6) or (7) for a second or subsequent
    24  offense, shall be guilty of a misdemeanor, and shall, upon
    25  conviction thereof in a court of quarter sessions, be sentenced
    26  to pay a fine of not less than two hundred dollars ($200.00) and
    27  not more than five hundred dollars ($500.00) and costs of
    28  prosecution, or undergo imprisonment for not more than three (3)
    29  years, or suffer both such fine and imprisonment.
    30     Any person violating the provisions of clause (6) of this

     1  section and who while so doing is in an accident resulting in a
     2  fatality shall, in addition to any fines provided by this
     3  section, be sentenced to a mandatory jail sentence for the
     4  maximum period heretofore set forth on conviction for a second
     5  or subsequent offense.

     7     Section 2.  This act shall take effect immediately.
