                                     AN ACT

     1  Amending the act of April 12, 1951 (P.L.90, No.21), entitled "An
     2     act relating to alcoholic liquors, alcohol and malt and
     3     brewed beverages; amending, revising, consolidating and
     4     changing the laws relating thereto; regulating and
     5     restricting the manufacture, purchase, sale, possession,
     6     consumption, importation, transportation, furnishing, holding
     7     in bond, holding in storage, traffic in and use of alcoholic
     8     liquors, alcohol and malt and brewed beverages and the
     9     persons engaged or employed therein; defining the powers and
    10     duties of the Pennsylvania Liquor Control Board; providing
    11     for the establishment and operation of State liquor stores,
    12     for the payment of certain license fees to the respective
    13     municipalities and townships, for the abatement of certain
    14     nuisances and, in certain cases, for search and seizure
    15     without warrant; prescribing penalties and forfeitures;
    16     providing for local option, and repealing existing laws,"
    17     further providing for general powers of the board as to
    18     management personnel in Pennsylvania Liquor Stores.

    19     The General Assembly of the Commonwealth of Pennsylvania
    20  hereby enacts as follows:
    21     Section 1.  Clause (f) of section 207 and section 303, act of
    22  April 12, 1951 (P.L.90, No.21), known as the "Liquor Code," are
    23  amended to read:
    24     Section 207.  General Powers of Board.--Under this act, the
    25  board shall have the power and its duty shall be:

     1     (f)  To appoint, fix the compensation and define the powers
     2  and duties of such managers, officers, inspectors, examiners,
     3  clerks and other employes as shall be required for the operation
     4  of this act, subject to the provisions of The Administrative
     5  Code of 1929 and the Civil Service Act. The duties and
     6  responsibilities of store managers, assistant store managers and
     7  clerks II shall be such as to permit them to remain in the
     8  "first level of supervision" as defined in Article III, section
     9  301, clause (19), act of July 23, 1970 (P.L.563, No.195), known
    10  as the "Public Employe Labor Relations Act."

    12     Section 303.  Management of Pennsylvania Liquor Stores.--
    13  Every Pennsylvania Liquor Store shall be conducted by a person
    14  appointed in the manner provided in the Civil Service Act who
    15  shall be known as the "manager" and who shall, under the
    16  directions of the board, be responsible for carrying out the
    17  provisions of this act and the regulations adopted by the board
    18  under this act as far as they relate to the conduct of such
    19  stores. Every multiple shift store shall have at least one
    20  assistant manager or clerk II to act in the manager's absence
    21  and whose duties and responsibilities shall conform to Article
    22  II, section 207, clause (f).
    23     Section 2.  This act shall take effect in 60 days.
