                                     AN ACT

     1  Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An
     2     act to consolidate, editorially revise, and codify the public
     3     welfare laws of the Commonwealth," providing an employment
     4     priority program.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  The act of June 13, 1967 (P.L.31, No.21), known
     8  as the "Public Welfare Code," is amended by adding a section to
     9  read:
    10     Section 489.  Employment Priority Program.--All departments
    11  and agencies of the Commonwealth of Pennsylvania shall give
    12  highest priority to the hiring of recipients ready for
    13  employment in the filling of personnel vacancies. Each
    14  Commonwealth department and agency shall have an affirmative
    15  hiring and promotion program for recipients ready for employment
    16  which shall include hiring in the ratio of one recipient of
    17  assistance for every non-recipient of assistance until the
    18  percentage of recipients in the employ of the department or
    19  agency equals the percentage of recipients to the total

     1  population in the Commonwealth. To the extent that any civil
     2  service test or requirement or other requirements for such jobs
     3  have not been tested for job relatedness, as that term is used
     4  by the United States Equal Employment Opportunity Commission, in
     5  that the requirements or tests have not been empirically found
     6  to be predictive of performance on the job, such requirements or
     7  tests shall be waived to enable hiring and promotion of
     8  recipients of assistance at all levels of the department or
     9  agency in the ratio set forth above. The jobs filled by
    10  recipients shall have all the protections of Federal and State
    11  safety and hours laws. Recipients shall be paid the prevailing
    12  wage for like work in the department or agency.
