AN ACT 1 To provide for the expenses of the Executive, Legislative and 2 Judicial Departments of the Commonwealth, the public debt and 3 for the public schools for the fiscal period July 1, 1975 to 4 June 30, 1976, and for the payment of bills incurred and 5 remaining unpaid at the close of the fiscal period ending 6 June 30, 1975. 7 The General Assembly of the Commonwealth of Pennsylvania 8 hereby enacts as follows: 9 Section 1. This act shall be known and may be cited as the 10 "General Appropriation Act of 1975." 11 Section 2. The following sums, or as much thereof as may be 12 necessary, are hereby specifically appropriated from the General 13 Fund to the several hereinafter named agencies of the Executive, 14 Legislative and Judicial Departments of the Commonwealth for the 15 payment of the salaries, wages or other compensation and travel 16 expense of the duly elected or appointed officers and employees 17 of the Commonwealth, for payment of fees of contractual services 18 rendered, for the purchase or rental of goods, services, 19 printing, equipment, land and buildings and for payment of any 20 other expenses, as provided by law or by this act, necessary for

1 Payment of rental charges to The General State 2 Authority for capital improvements at State-aided 3 educational institutions.......................... 4,486,000 4 Operation, maintenance and administration of 5 the State colleges and State-owned university..... 150,873,000 6 Notwithstanding any other provision of this or 7 any other act every 30 days the Secretary of Education 8 shall transmit to the chairpersons of the House and 9 Senate Appropriations Committees and the chairpersons 10 of the House and Senate Education Committees a list 11 of persons who are proposed for employment in a 12 position whose salary exceeds $14,000 per year, within 13 the Department of Education at any State-owned college 14 or university. 15 In addition to the name of the proposed employees 16 and the proposed compensation, the list shall contain 17 a brief job description and a justification for the 18 proposed employment. 19 The list of proposed employees required under this 20 section shall be effective at the end of the first period 21 of 12 legislative days unless after the date of trans- 22 mittal and before the passage of the 12 legislative 23 days either house passes a resolution by a two-thirds 24 vote stating in substance the House or Senate does not 25 approve all or any of the proposed contracts of 26 employment listed therein. 27 There shall be no further disbursement of funds 28 appropriated for the State-owned colleges and 29 university after September 30, 1975, until the 30 Chairpersons of the House and Senate Appropriations 19750H1336B1761 - 12 -
1 Committees and the Chairpersons of the House and 2 Senate Education Committees have received copies 3 of letters notifying at least five per cent of the 4 current faculty members and at least five per cent 5 of the current administrators and one vice-presi- 6 dent at each of these institutions that they are 7 to be retrenched as of September 1, 1976. When 8 the Chairpersons of the respective Committees 9 have received proof of retrenchment notification 10 they shall then notify the Treasurer of the 11 Commonwealth who may authorize disbursements from 12 appropriated funds to these institutions. 13 As an additional condition precedent to the 14 disbursement of appropriated funds after September 15 30, 1975 to the State-owned colleges and university, 16 each of these institutions shall furnish satis- 17 factory evidence to the Chairpersons of the House 18 and Senate Appropriations Committees and the 19 Chairpersons of the House and Senate Education 20 Committees that, commencing with the academic year 21 that begins in September 1975, all programs of 22 academic fee remission and tuition waiver for 23 employees of these respective institutions are 24 abolished. 25 Operation, maintenance and administration of the 26 Pennsylvania State Oral School at Scranton........ 1,522,000 27 Operation, maintenance and administration of 28 Scotland School for Veterans' Children............ 3,587,000 29 Operation, maintenance and administration of 30 the Thaddeus Stevens Trade School at Lancaster.... 1,701,000 19750H1336B1761 - 13 -

This act is not intended to be inconsistent with 5 or to repeal any provision of any act enacted at this or any 6 prior session of the General Assembly regulating the purchase of 7 supplies, the ordering of printing and binding, the purchase, 8 maintenance and use of automobiles, the method of making 9 payments from the State Treasury for any purpose or the 10 functioning of any administrative department, board or 11 commission. 12 Section 4. No appropriation made by this act to any 13 department, board, commission or agency of the Executive 14 Department shall be available unless and until such department, 15 board, commission or agency shall have complied with sections 16 604, 605 and 606 of The Administrative Code of 1929. 17 Section 5. The term "employees" as used in this act shall 18 include all directors, superintendents, bureau or division 19 chiefs, assistant directors, assistant superintendents, 20 assistant chiefs, experts, scientists, engineers, surveyors, 21 draftsmen, accountants, secretaries, auditors, inspectors, 22 examiners, statisticians, marshals, clerks, stenographers, 23 bookkeepers, messengers and other assistants in any department, 24 board or commission. 25 Section 6. The term "expenses" and "maintenance" shall 26 include all printing, binding and stationery, food and forage, 27 materials and supplies, traveling expenses, training, motor 28 vehicle supplies and repairs, freight, express, and cartage, 29 postage, telephones and telegraph rentals and toll charges, 30 newspaper advertising and notices, fuel, light, heat, power and 19750H1336B1761 - 54 -
1 water, minor construction and renovation, repairs or 2 reconstruction of equipment, buildings and facilities, rent of 3 real estate and equipment, premiums on workmen's compensation, 4 insurance premiums on policies of liability insurance, premiums 5 on medical payment insurance and surety bonds for volunteer 6 workers, premiums on employee group life insurance, and employee 7 and retired employee group hospital and medical insurance, 8 payment of Commonwealth share of social security taxes and 9 unemployment compensation costs for State employees, the 10 purchase of replacement or additional equipment and machinery 11 and all other incidental costs and expenses, including payment 12 to the Department of Property and Supplies of mileage and other 13 charges for the use of automobiles and rental payments for 14 permanently assigned automobiles and of expenses or costs of 15 services incurred through the Purchasing Fund. The term 16 "expenses" also shall include the medical costs for the 17 treatment of inmates of State institutions when the inmate must 18 be transferred to an outside hospital: Provided, That in no case 19 shall the State institution pay more for patient care than that 20 provided under the State medical assistance program. 21 Section 7. Purchase of supplies, materials and equipment 22 shall not be deemed to be committed or encumbered until 23 contracts covering said purchase have been entered into with the 24 vendors. 25 Section 8. (a) In addition to the amounts appropriated by 26 this act, moneys received in payment for food and household 27 supplies furnished to employees and other persons, except 28 inmates, by an institution, and moneys received from the 29 proceeds from the sale of any products of the soil, meats, 30 livestock, timber, or other materials sold by the department 19750H1336B1761 - 55 -
1 shall be paid into the General Fund and are hereby appropriated 2 out of the General Fund to the several respective institutions 3 for the operation and maintenance of said institutions. 4 (b) In addition to the amounts appropriated by this act, all 5 moneys received from the Federal Government, or from any other 6 source as contributions for the programs provided herein, or as 7 payment for services or materials furnished by one institution 8 to another, except those collections designated as revenues, 9 shall be paid into the General Fund and are hereby appropriated 10 out of the General Fund for the purposes of the respective 11 appropriations. 12 (c) In addition to any funds specifically appropriated by 13 this act, all moneys received by a department or agency of the 14 Commonwealth from the Federal Government or from any other 15 source as contributions or supplements to the department or 16 agency for a program or administration of an act included in 17 this act shall be paid into the General Fund and credited to the 18 appropriation for that program or administration of the act. 19 Section 9. That part of all appropriations in this act 20 unexpended, uncommitted and unencumbered as of June 30, 1976 21 shall automatically lapse as of that date. 22 Section 10.
