                                     AN ACT

     1  Amending the act of July 28, 1953 (P.L.723, No.230), entitled,
     2     as amended, "An act relating to counties of the second class
     3     and second class A; amending, revising, consolidating and
     4     changing the laws relating thereto," changing membership of
     5     and providing for Disabled American Veterans as members on
     6     the board of managers of a memorial hall.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Subsection (b) of section 2565 and section 2566,
    10  act of July 28, 1953 (P.L.723, No.230), known as the "Second
    11  Class County Code," amended June 19, 1961 (P.L.463, No.232), are
    12  amended to read:
    13     Section 2565.  Personnel.--The board of managers shall
    14  consist of:
    15     * * *
    16     (b)  Elective members [(fifteen):  the present elective
    17  members representing the Veterans of the Civil War shall be and
    18  continue as members of such board until removed by death,
    19  resignation, or otherwise] (twenty): The [remaining] members of


     1  the elective [(fifteen)] (twenty) shall be filled by the
     2  following organizations out of their membership: [(three)] (one)
     3  by the county organization of the United Spanish War Veterans;
     4  [(three)] (five) by the county organization of the American
     5  Legion; [(three)] (five) by the county organization of the
     6  Veterans of Foreign Wars; [(three)] (four) by the county
     7  organizations of the Italian American War Veterans of the United
     8  States, Incorporated; (five) by the county organization of the
     9  Disabled American Veterans; within thirty days from the date
    10  when this act becomes effective; and they shall certify such
    11  election to the secretary of the existing board, whereupon the
    12  persons so elected shall be members of the board.
    13     Section 2566.  Vacancies.--Vacancies occurring among the
    14  elective members of the board shall be filled by the
    15  organization which chose the members whose place it is desired
    16  to fill. [Provided, however, That whenever it may appear that it
    17  is impossible to fill any vacancy in the board caused by the
    18  death or resignation of a member thereof who represented the
    19  Veterans of the Civil War because no organization survives to
    20  choose such members or no person survives who can qualify for
    21  such membership, vacancies so created and existing shall, upon
    22  notice from the secretary, be filled by the county organizations
    23  of the United Spanish War Veterans and the American Legion and
    24  the Veterans of Foreign Wars and the Italian American War
    25  Veterans of the United States, Incorporated. That is to say, the
    26  first vacancy so caused shall be filled by the county
    27  organization of the United Spanish War Veterans, the second by
    28  the county organization of the American Legion, and the third by
    29  the county organization of the Veterans of Foreign Wars, and so
    30  on in rotation. That is to say, that when no member representing

     1  the Veterans of the Civil War shall remain on said board, the
     2  elective personnel of the board shall be as follows: Elective
     3  members sixteen; United Spanish War Veterans (four); American
     4  Legion (four); Veterans of Foreign Wars (four); Italian American
     5  War Veterans of the United States, Incorporated (four).]
     6     Section 2.  This act shall take effect immediately.
