AN ACT 1 Amending the act of May 16, 1929 (P.L.1784, No.587), entitled 2 "An act concerning newspapers; creating uniformity in the 3 publication of legal notices and advertisements; defining the 4 newspapers in which official and legal advertising shall be 5 published; prescribing methods for computing the charges 6 therefor, and providing that the expenses for publishing 7 legal advertising or notices shall be taxable and collectible 8 as court costs are now taxed and collected in all matters and 9 proceedings," further defining "newspaper" and "subscriber." 10 The General Assembly of the Commonwealth of Pennsylvania 11 hereby enacts as follows: 12 Section 1. Clause (1) of section 3, act of May 16, 1929 13 (P.L.1784, No.587), known as the "Newspaper Advertising Act," 14 amended July 5, 1947 (P.L.1297, No.520), is amended to read: 15 Section 3. The following words, wherever used in the acts of 16 Assembly of this Commonwealth now in force or hereafter enacted, 17 shall have the following meanings: 18 (1) "Newspaper" means a printed paper or publication, bearing 19 a title or name, and conveying reading or pictorial intelligence 20 of passing events, local or general happenings, printing 21 regularly or irregularly editorial comment, announcements, 22 miscellaneous reading matter, commercial advertising, classified
1 advertising, legal advertising, and other notices, and which has 2 been issued in numbers of four or more pages at short intervals, 3 either daily, twice or oftener each week, or weekly, 4 continuously during a period of at least six months, or as the 5 successor of such a printed paper or publication issued during 6 an immediate prior period of at least six months, and which has 7 been circulated and distributed from an established place of 8 business to subscribers or readers without regard to number, for 9 a definite price or consideration, (meaning payment "required" 10 to be served, not "voluntary), either entered or entitled to be 11 entered under the Postal Rules and Regulations as second class 12 matter in the United States mails, and subscribed for by readers 13 at a fixed price for each copy, or at a price fixed per annum: 14 Provided, A newspaper may be either a daily newspaper, weekly 15 newspaper, newspaper of general circulation, official newspaper, 16 or a legal newspaper, as defined by this act: And provided 17 further, That continuous publication within the meaning of this 18 section shall not be deemed interrupted by any involuntary 19 suspension of publication resulting from loss, destruction, 20 failure or unavailability of operating facilities, equipment or 21 personnel from whatever cause, and any newspaper so affected 22 shall not be disqualified to publish legal and official 23 advertising in the event that publication is resumed within one 24 week after it again becomes possible. 25 * * * 26 Section 2. Clause (13) of section 3 of the act is amended to 27 read: 28 Section 3. 1 * * * 2 (13) "Subscriber" means a person or persons, corporation, 3 association or society, which [buys or] orders verbally or by 4 written subscription, or accepts upon delivery from the United 5 States mails or a carrier, for a definite price or 6 consideration, issues or copies of any newspaper, journal, legal 7 newspaper, periodical or magazine. 8 * * * D25L13JR/19750H1192B1375 - 3 -
