                                     AN ACT

     1  Amending the act of August 26, 1971 (P.L.351, No.91), entitled
     2     "An act providing for a State Lottery and administration
     3     thereof; authorizing the creation of a State Lottery
     4     Commission; prescribing its powers and duties; disposition of
     5     funds; violations and penalties therefor; exemption of prizes
     6     from State and local taxation and making an appropriation,"
     7     requiring the approval of the General Assembly for the types
     8     and manner of promoting and conducting lotteries.

     9     The General Assembly of the Commonwealth of Pennsylvania
    10  hereby enacts as follows:
    11     Section 1.  Section 6, act of August 26, 1971 (P.L.351,
    12  No.91), known as the "State Lottery Law," is amended by adding a
    13  subsection to read:
    14     Section 6.  Powers and Duties of the Secretary of Revenue.--

    16     (c)  The Secretary of Revenue shall not establish, change,
    17  operate or administer a lottery or lotteries or promulgate rules
    18  and regulations relating to the establishment or change of a
    19  lottery or lotteries until the General Assembly, by concurrent
    20  resolution, approves the following as to each lottery:
    21     (1)  The type of lottery to be conducted.

     1     (2)  The price, or prices, of tickets or shares in the
     2  lottery.
     3     (3)  The numbers and sizes of the prizes on the winning
     4  tickets or shares.
     5     (4)  The manner of selecting the winning tickets or shares.
     6     (5)  The manner of payment of prizes to the holders of
     7  winning tickets or shares.
     8     (6)  The frequency of the drawings or selections of winning
     9  tickets or shares, without limitation.
    10     (7)  The method to be used in selling tickets or shares.
    11     (8)  The methods to be used in advertising and promoting the
    12  lottery.
    13     Should the General Assembly fail to act within ninety
    14  calendar days from the date the proposed establishment or change
    15  of a lottery was presented, the change shall be deemed approved.
    16     Section 2.  This act shall take effect in 90 days and shall
    17  apply only to lotteries established or changed after the
    18  effective date of this act.
