AS AMENDED ON THIRD CONSIDERATION, HOUSE OF REPRESENTATIVES,
JULY 2, 1975
AN ACT
1 Amending the act of May 31, 1945 (P.L.1198, No.418), entitled,
2 as amended, "An act providing for the conservation and
3 improvement of land affected in connection with surface
4 mining; regulating such mining; and providing penalties,"
5 requiring the reclamation plan to be filed with the county
6 planning commission.
7 The General Assembly of the Commonwealth of Pennsylvania
8 hereby enacts as follows:
9 Section 1. Section 4, act of May 31, 1945 (P.L.1198,
10 No.418), known as the "Surface Mining Conservation and
11 Reclamation Act," is amended by adding a subsection to read:
12 Section 4. * * *
13 (k) The reclamation plan approved by the department shall be
14 FURNISHED BY THE DEPARTMENT TO BE filed with the county planning <--
15 commission of the county in which the operation is to be
16 undertaken IF THE COUNTY PLANNING COMMISSION REQUESTS THE SAME. <--
17 The plan shall be so filed before the permit is issued. <--
18 Section 2. This act shall take effect in 60 days.
