                                     AN ACT

     1  Amending the act of May 29, 1956 (P.L.1804, No.600), entitled
     2     "An act providing for the establishment of police pension
     3     funds or pension annuities in certain boroughs, towns and
     4     townships, and the regulation and maintenance thereof;
     5     providing for an actuary; continuance of existing funds or
     6     transfer thereof to funds herein established; prescribing
     7     rights of beneficiaries; contributions by members; providing
     8     for expenses of administration; continuation of existing
     9     authority to provide annuity contracts; credit for military
    10     service, refunds; exempting allowances from judicial process;
    11     and repealing certain acts," further providing for
    12     eligibility for and payment of pensions.

    13     The General Assembly of the Commonwealth of Pennsylvania
    14  hereby enacts as follows:
    15     Section 1.  The act of May 29, 1956 (P.L.1804, No.600),
    16  entitled "An act providing for the establishment of police
    17  pension funds or pension annuities in certain boroughs, towns
    18  and townships, and the regulation and maintenance thereof;
    19  providing for an actuary; continuance of existing funds or
    20  transfer thereof to funds herein established; prescribing rights
    21  of beneficiaries; contributions by members; providing for
    22  expenses of administration; continuation of existing authority
    23  to provide annuity contracts; credit for military service;


     1  refunds; exempting allowances from judicial process; and
     2  repealing certain acts," is amended by adding a section to read:
     3     Section 5.1.  Any police officer previously employed as a
     4  full-time police officer by one municipality who comes under the
     5  terms of this act by virtue of an increase in the number of
     6  full-time police officers employed by his municipality who
     7  retires or has retired subsequent to January 1, 1970 and upon
     8  attainment of age sixty-five, without fulfilling the length of
     9  service requirements under this act, or any full-time police
    10  officer who, because of his age at the time of his employment is
    11  prevented from fulfilling the length of service requirements
    12  under this act, shall receive a proportionate pension based upon
    13  his years of service.
    14     Section 2.  This act shall take effect immediately.
