                                     AN ACT

     1  Amending the act of April 29, 1959 (P.L.58, No.32), entitled "An
     2     act consolidating and revising the Vehicle Code, the Tractor
     3     Code, the Motor Vehicle Financial Responsibility Act and
     4     other acts relating to the ownership, possession and use of
     5     vehicles and tractors," further providing for inspection of
     6     school buses.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Subsections (i) and (j) of section 834, act of
    10  April 29, 1959 (P.L.58, No.32), known as "The Vehicle Code,"
    11  amended January 10, 1972 (1971 P.L.678, No.183), are amended to
    12  read:
    13     Section 834.  Official Inspections.--
    14     * * *
    15     (i)  The secretary is hereby authorized and required to issue
    16  a certificate of school bus inspection for every vehicle owned
    17  by, or used under contract with, any school or school district
    18  which conforms with the provisions of this act including
    19  regulations of the Bureau of Traffic Safety of the department.


     1  Such certificate shall bear the approval of and be countersigned
     2  by the Commissioner of the Pennsylvania State Police. [This
     3  provision shall not apply to motor buses operated by common
     4  carriers holding a certificate of the Public Utility Commission
     5  or to motor omnibuses operated by Municipality Authorities, Port
     6  Authorities or Transportation Authorities over regular routes in
     7  scheduled service even if such motor buses and motor omnibuses
     8  are also used for transportation of school children off such
     9  routes: Provided, That loading zones on any school route, off
    10  the certificated routes of common carriers or the regular
    11  schedules routes of authorities, are in business or residence
    12  districts or are loading zones designated by official signs
    13  erected by the proper authorities.]
    14     (j)  The owner of every vehicle which is to be used for the
    15  transportation of school children shall, in addition to any
    16  other inspection required by this act, submit such vehicle to
    17  the Pennsylvania State Police sometime during every August, or
    18  prior to operating such vehicle for the transportation of school
    19  children during the school year, to determine whether such
    20  vehicle conforms with the provisions of this act including
    21  regulations of the Bureau of Traffic Safety of the department.
    22  [This provision shall not apply to motor buses operated by
    23  common carriers holding a certificate of the Public Utility
    24  Commission or to motor omnibuses operated by Municipality
    25  Authorities, Port Authorities or Transportation Authorities over
    26  regular routes in scheduled service even if such motor buses and
    27  motor omnibuses are also used for transportation of school

     4     Penalty.--Any person violating any of the provisions of
     5  subsection (d), (e), (g), (h), (j) or (k) of this section,
     6  shall, upon summary conviction before a magistrate, be sentenced
     7  to pay a fine of not more than ten dollars ($10.00) and costs of
     8  prosecution, and, in default of the payment thereof, shall
     9  undergo imprisonment for not more than five (5) days. Any person
    10  violating the provisions of subsection (h) of this section,
    11  shall be given by the arresting officer a ticket, whereon shall
    12  be indicated the date, time and place of arrest, and such person
    13  shall not be proceeded against more than one (1) time within any
    14  twenty-four hour period for the violation of said subsection.
    15     Section 2.  This act shall take effect immediately.
