                                     AN ACT

     1  Amending the act of July 19, 1974 (No.176), entitled "An act
     2     providing for a compensation system for persons injured in
     3     motor vehicle accidents; requiring insurance for all motor
     4     vehicles required to be registered in Pennsylvania; defining
     5     compensable damage in motor vehicle accident cases;
     6     establishing an assigned claims plan; providing for
     7     arbitration; imposing powers and duties on courts, the
     8     Department of Transportation and the Insurance Commissioner;
     9     prohibiting certain discrimination; and providing penalties,"
    10     providing for relief from purchase of special risk insurance
    11     by certain persons and return of licenses and registrations.

    12     The General Assembly of the Commonwealth of Pennsylvania
    13  hereby enacts as follows:
    14     Section 1.  The act of July 19, 1974 (No.176), known as the
    15  "Pennsylvania No-fault Motor Vehicle Insurance Act," is amended
    16  by adding a section to read:
    17     Section 105.1.  Relief from Requirement of Purchasing Special
    18  Risk Insurance; Return of Licenses, Registrations.--Any person
    19  who heretofore furnished proof of financial responsibility
    20  pursuant to Article XIV of "The Vehicle Code," because of a
    21  motor vehicle accident in which he was the owner or operator and
    22  which resulted in injury or damage to the person or property of

     1  others and who has paid all claims and judgments against him
     2  therefor upon proof thereof furnished to the secretary shall on
     3  the effective date of the act to which this is an amendment have
     4  his special proof of financial responsibility thereafter waived,
     5  and the security, if any, returned to him, or the bond
     6  evidencing it cancelled, by the secretary and shall not be
     7  required to purchase special risk insurance under section 105
     8  but may provide the insurance required under section 104 as
     9  though he had not had such accident. At such time also any such
    10  person's registration suspension or revocation, if any, shall
    11  end and the secretary shall return his license and registration
    12  without requiring further proof of financial responsibility.
    13     Section 2.  This act shall take effect July 18, 1975.
