AN ACT 1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania 2 Consolidated Statutes, redefining the offense of robbery and 3 adding an additional grade for the offense. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Section 3701 of Title 18, act of November 25, 7 1970 (P.L.707, No.230)), known as the Pennsylvania Consolidated 8 Statutes, added December 6, 1972 (P.L.1482, No.334), is amended 9 to read: 10 § 3701. Robbery. 11 (a) Offense defined.-- 12 (1) A person is guilty of robbery if, in the course of 13 committing a theft, he: 14 (i) inflicts [serious] bodily injury upon another; 15 (ii) threatens another with or intentionally puts 16 him in fear of immediate [serious] bodily injury; [or] 17 (iii) commits or threatens immediately to commit any 18 felony of the first or second degree; or 19 (iv) physically takes or removes property from the
1 person of another by force however slight. 2 (2) An act shall be deemed "in the course of committing 3 a theft" if it occurs in an attempt to commit theft or in 4 flight after the attempt or commission. 5 (b) Grading.--Robbery under subsection (a)(1)(iv) is a 6 felony of the third degree; otherwise, it is a felony of the 7 first degree. 8 Section 2.
