                                     AN ACT

     1  Amending the act of June 23, 1931 (P.L.932, No.317), entitled
     2     "An act relating to cities of the third class; and amending,
     3     revising, and consolidating the law relating thereto,"
     4     changing minimum pensions.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Subsection (a) of section 4303, act of June 23,
     8  1931 (P.L.932, No.317), known as "The Third Class City Code,"
     9  reenacted and amended June 28, 1951 (P.L.662, No.164) and
    10  amended May 9, 1961 (P.L.178, No.88), is amended to read:
    11     Section 4303.  Allowances and Service Increments.--(a)
    12  Payments for allowances shall not be a charge on any other fund
    13  in the treasury of the city or under its control save the police
    14  pension fund herein provided for. The basis of the apportionment
    15  of the pension shall be determined by the rate of the monthly
    16  pay of the member at the date of injury, death, honorable
    17  discharge, or retirement, or the highest average annual salary
    18  which the member received during any five years of service
    19  preceding injury, death, honorable discharge, or retirement,

     1  whichever is the higher, and except as to service increments
     2  provided for in subsection (b) of this section, shall not [in
     3  any case exceed] in any year be less than one-half the annual
     4  pay of such member computed at such monthly or average annual
     5  rate, whichever is the higher.
