AN ACT 1 Authorizing the Department of Property and Supplies, with the 2 approval of the Governor, to sell and convey to the 3 Canonsburg-Houston Joint Authority a certain tract of land in 4 Cecil Township, Washington County. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. The Department of Property and Supplies, with the 8 approval of the Governor, is hereby authorized on behalf of the 9 Commonwealth of Pennsylvania to sell and convey to the 10 Canonsburg-Houston Joint Authority for a consideration of $1, 11 the following described tract of land situate in Cecil Township, 12 Washington County, Pennsylvania: 13 All that certain tract or piece of land situate in Cecil 14 Township, County of Washington, State of Pennsylvania, more 15 particularly described as follows: 16 Parcel II 17 Beginning at a point on the southerly right-of-way line of 18 the Penn Central Railroad right-of-way, said point being the 19 northeasterly most corner of Parcel I, the 6.245 acre tract
1 formerly procured for the existing primary treatment plant 2 facilities from the Commonwealth of Pennsylvania to the Borough 3 of Canonsburg and Houston as recorded in Washington County Deed 4 Book, Volume 1119, page 30, and then conveyed by the Boroughs of 5 Canonsburg and Houston to the Canonsburg-Houston Joint 6 Authority, as recorded in Washington County Deed Book Volume 7 1119, page 43; thence from said point of beginning and 8 continuing along the southerly right-of-way line of the Penn 9 Central Railroad by a curve to the left having a radius of 10 1943.08 feet and an arc distance of 509.83 feet (chord bearing, 11 north 50 degrees 45 minutes 00 seconds east, a distance of 12 508.37 feet) to a point; thence by same, north 43 degrees 14 13 minutes 00 seconds east, a distance of 18.11 feet to a point, 14 thence through the common property line of Parcel II and Parcel 15 IV (portion reserved and maintained by The Western State School 16 and Hospital with an area of 1.026 acres), south 57 degrees 48 17 minutes 18 seconds west, a distance of 354.18 feet to a point in 18 Chartiers Creek; thence continuing in or along Chartiers Creek, 19 south 18 degrees 15 minutes 05 seconds west, a distance of 20 124.82 feet to a a point; thence by same, south 11 degrees 41 21 minutes 58 seconds west, a distance of 307.06 feet to a point; 22 thence by same, south 08 degrees 02 minutes 30 seconds west, a 23 distance of 131.03 feet to a point; thence by same, south 27 24 degrees 50 minutes 36 seconds west, a distance of 166.33 feet to 25 a point; thence by same, south 46 degrees 16 minutes 07 seconds 26 west, a distance of 128.47 feet to a point; thence by same, 27 south 54 degrees 39 minutes 50 seconds west, a distance of 28 100.19 feet to a point; thence by same, south 70 degrees 47 29 minutes 23 seconds west, a distance of 123.26 feet to a point; 30 thence by same, south 87 degrees 28 minutes 59 seconds west, a 19750H0344B0381 - 2 -
1 distance of 195.30 feet to a point; thence by same, north 79 2 degrees 02 minutes 18 seconds west, a distance of 141.00 feet to 3 a point; thence leaving Chartiers Creek and by line of lands of 4 the 6.245 acre tract, site of the existing plant, north 25 5 degrees 31 minutes 20 seconds east, a distance of 177.27 feet to 6 a point; thence by same, north 29 degrees 36 minutes 00 seconds 7 east, a distance of 373.51 feet to a point; thence by same, 8 north 31 degrees 44 minutes 00 seconds west, a distance of 9 275.36 feet to a point on the southerly right-of-way line of the 10 Penn Central Railroad right-of-way, the point of beginning 11 containing 11.825 acres. 12 Said parcel of property is shown on Drawing No. D-2171, 13 prepared under the seal of James S. Patton, Registered 14 Professional Engineer No. 18320-E of Engelhardt-Power and 15 Associates, Inc. and entitled: "Survey of Property of the 16 Commonwealth of Pennsylvania required for the Wastewater 17 Treatment Plant Additions" dated March 27, 1974; and further 18 certified correct by Arthur P. Deemer, Jr., Registered 19 Professional Engineer, Pennsylvania No. 6042. 20 Section 2. The conveyance shall be made under and subject, 21 nevertheless, to all easements, servitudes and rights of others, 22 including, but not confined to streets, roadways, and rights of 23 any telephone, telegraph, water, electric, gas or pipeline 24 companies, as well as under and subject, nevertheless, to any 25 estate or tenancies vested in third persons, whether or not 26 appearing of record, for any portion of the said land. 27 Section 3. The deed of conveyance shall be approved by the 28 Department of Justice and shall be executed by the Secretary of 29 Property and Supplies in the name of the Commonwealth of 30 Pennsylvania. 19750H0344B0381 - 3 -
