                                     AN ACT

     1  Amending the act of July 19, 1974 (No.175), entitled "An act
     2     requiring public agencies to hold certain meetings and
     3     hearings open to the public and providing penalties,"
     4     providing for public notice in case of certain meetings of
     5     the General Assembly and excepting meetings of the Ethics
     6     Committee of the House of Representatives or the Senate.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 5, act of July 19, 1974 (No.175),
    10  entitled "An act requiring public agencies to hold certain
    11  meetings and hearings open to the public and providing
    12  penalties," is amended by adding a subsection to read:
    13     Section 5.  * * *
    14     (g)  Notwithstanding any provision of this section to the
    15  contrary, in case of sessions of the General Assembly, all
    16  meetings of legislative committees to be held within the Capitol
    17  complex where bills are considered, and all legislative hearings
    18  to be held within the Capitol complex where testimony is taken,
    19  the requirement for public notice thereof shall be complied with
    20  if within the time limits prescribed by this section:


     1     (1)  the Supervisor of the Newsroom of the State Capitol
     2  Building in Harrisburg is supplied for distribution to the
     3  members of the Pennsylvania Legislative Correspondents
     4  Association with a minimum of thirty copies of the notice of the
     5  date, time and place of each session, meeting or hearing:
     6  Provided, That where the prescribed notice has been supplied
     7  containing the specific number of days of a week scheduled for
     8  legislative sessions of the House or Senate, but the House or
     9  Senate thereafter determines to be in a greater number of
    10  session days than that originally scheduled for such week, the
    11  public notice requirement for such additional session days shall
    12  be deemed complied with, if the Speaker of the House or
    13  presiding officer of the Senate, as the case may be, makes
    14  public announcement during open meeting of a regularly scheduled
    15  session of the date, time and place of the additional session
    16  day or days and notice is posted as prescribed by this section;
    17  and
    18     (2)  there is a posting of the copy of such notice at a
    19  public place within the main Capitol building designated by the
    20  Chief Clerk and the Secretary of the Senate.
    21     Notwithstanding any provision to the contrary, committees may
    22  be called into session by an announcement by the Speaker of the
    23  House or the presiding officer of the Senate: Provided, That
    24  such announcement is made in open session of the House or the
    25  Senate.
    26     Section 2.  Section 7 of the act is amended to read:
    27     Section 7.  For the purpose of this act, meetings of the
    28  Legislature which are covered are as follows: all meetings of
    29  committees where bills are considered, all hearings where
    30  testimony is taken, all sessions of the House of Representatives

     1  and the Senate. Not included in the intent of this act are party
     2  caucuses, nor any meeting of the Ethics Committee of the House
     3  of Representatives or the Senate.
     4     Section 3.  This act shall take effect immediately.
