                                     AN ACT

     1  Amending the act of July 19, 1974 (No.175), entitled "An act
     2     requiring public agencies to hold certain meetings and
     3     hearings open to the public and providing penalties,"
     4     providing for additional coverage.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 1 of the act of July 19, 1974 (No.175),
     8  entitled "An act requiring public agencies to hold certain
     9  meetings and hearings open to the public and providing
    10  penalties," is amended to read:
    11     Section 1.  As used in this act:
    12     "Agency" means any branch, department, board, authority or
    13  commission of the Commonwealth of Pennsylvania, any political
    14  subdivision of the Commonwealth, or any State, municipal,
    15  township or school authority, school board, school governing
    16  body, commission, the board of trustees of all State-aided
    17  colleges and universities, the board of trustees of all State-
    18  owned and State-related colleges and universities and all
    19  community colleges, or similar organization created by or

     1  pursuant to a statute which declares in substance that the
     2  organization performs or has for its purpose the performance of
     3  an essential governmental function: Provided, That the term
     4  "agency" shall include the courts of common pleas when
     5  appointing members of boards of education and boards of viewers,
     6  the General Assembly, or any State department, board, authority
     7  or commission to include the Governor's cabinet when meeting on
     8  official policy making business.
     9     "Formal action" means the taking of any vote on any
    10  resolution, rule, order, motion, regulation or ordinance or the
    11  setting of any official policy. Meetings, pre-trial conferences,
    12  hearings, and formal action by the judiciary or judicial branch
    13  shall not be subject to the provisions of this act.
    14     Section 2.  This act shall take effect immediately.
