AN ACT 1 Amending the act of April 29, 1959 (P.L.58, No.32), entitled "An 2 act consolidating and revising the Vehicle Code, the Tractor 3 Code, the Motor Vehicle Financial Responsibility Act and 4 other acts relating to the ownership, possession and use of 5 vehicles and tractors," requiring protectors or flaps behind 6 the rearmost wheels of certain vehicles and changing 7 penalties. 8 The General Assembly of the Commonwealth of Pennsylvania 9 hereby enacts as follows: 10 Section 1. Section 830, act of April 29, 1959 (P.L.58, 11 No.32), known as "The Vehicle Code," is amended to read: 12 Section 830. [Commercial] Certain Vehicles To Be Equipped 13 with Rear Wheel Flaps or Shields.--(a) Every motor bus, motor 14 omnibus, commercial motor vehicle, tractor and trailer and every 15 combination of such a [commercial] motor vehicle and trailer or 16 of a truck tractor and semi-trailer, when used on a highway, 17 shall be so constructed or equipped [as] with suitable metal
1 protectors or substantial flexible flaps behind the rearmost 2 wheels of the vehicle or combination or any wheel extending 3 beyond the side of the body or fenders of the vehicle or tractor 4 to minimize side spray and to bar water or other road surface 5 substances thrown from the [rear] wheels of such vehicle or 6 combination. [at tangents exceeding twenty-two and one-half (22 <-- 7 1/2) degrees, measured from the road surface, from passing in a 8 straight line to the rear of such vehicle or combination.] <-- 9 (b) The protectors or flaps shall have a ground clearance of 10 not more than one-third (1/3) of the horizontal distance from 11 the bottom edge of the protector or flap to the center line of 12 the axle, provided, however, that no protector or flap need be 13 closer to the ground than six (6) inches under any condition of 14 loading. The protector or flap shall extend laterally at least 15 the width of the tire or tires being protected. 16 (c) If any motor vehicle, including semi-trailers and 17 trailers, is so designed or constructed that the objectives of 18 this section are accomplished by reason of fender or body 19 construction or other means of enclosure, either permanent or 20 temporary, then the requirements of this section have been 21 satisfied. 22 (d) This section shall not apply to any farm tractor or to <-- 23 uncoupled truck tractors "OR TO UNCOUPLED TRUCK TRACTORS" or to <-- 24 pole trailers or other vehicles where the construction is such 25 that complete freedom around the wheel area is necessary to 26 secure the designed use of the vehicle. 27 Penalty.--Any person violating any of the provisions of this 28 section shall, upon summary conviction before a magistrate, be 29 sentenced to pay a fine of [ten dollars ($10.00)] fifty dollars 30 ($50.00) and costs of prosecution, and in default of the payment 19730S0511B1150 - 2 -
