        AS REPORTED FROM COMMITTEE ON STATE GOVERNMENT, HOUSE OF
           REPRESENTATIVES, AS AMENDED, DECEMBER 18, 1973

                                     AN ACT

     1  Authorizing the Department of Property and Supplies, with the
     2     approval of the Governor and the Secretary of Transportation,
     3     to sell and convey certain lots or tracts of ground with
     4     improvements thereon situate in Lower Allen Township,
     5     Cumberland County.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  The Department of Property and Supplies, with the
     9  approval of the Governor and the Secretary of Transportation, is
    10  hereby authorized on behalf of the Commonwealth of Pennsylvania
    11  to sell, AFTER APPRAISAL THE COST OF WHICH SHALL BE BORNE BY THE  <--
    12  GRANTEE AT THE TIME OF SETTLEMENT, at public sale, to the
    13  highest bidder, RESERVING THE RIGHT TO ACCEPT OR REJECT ANY OR    <--
    14  ALL BIDS, and convey all or/and any of the following described
    15  tracts of land with any improvements thereon situate in Lower
    16  Allen Township, County of Cumberland, in the Commonwealth of
    17  Pennsylvania:
    18     Tract No. 1.  All that certain tract or parcel of land with
    19  the buildings and improvements thereon erected, situate in Lower


     1  Allen Township, Cumberland County, Pennsylvania more
     2  particularly bounded and described as follows, to wit:
     3     Beginning at a point on the Northerly line of Kensington
     4  Drive, which point is 240.20 feet West of the Northwesterly
     5  corner of Kensington Drive and Scarsdale Drive (both extended)
     6  and at the dividing line between Lots Nos. 4 and 5, Block "A" on
     7  the hereinafter mentioned Plan of Lots; thence along the
     8  Northerly line of Kensington Drive in an arc curving to the left
     9  having a radius of 160 feet in a Westerly direction 36.22 feet
    10  to a point; thence further along the Northerly line of
    11  Kensington Drive South 55 degrees 20 minutes West 38.78 feet to
    12  a point at the dividing line between Lots Nos. 5 and 6, Block
    13  "A" on said Plan; thence along said dividing line North 34
    14  degrees 40 minutes West 140 104.92 feet to a point; thence North  <--
    15  55 58 degrees 20 minutes East 107.88 59 MINUTES 34.5 SECONDS      <--
    16  EAST 98.54 feet to a point, at dividing line between Lots Nos. 4
    17  and 5, Block "A" aforesaid; thence along same South 21 degrees
    18  42 minutes East 147.85 105.40 feet to a point, the place of       <--
    19  Beginning CONTAINING 0.205 ACRES.                                 <--
    20     Being Lot No. 5, Block "A", in Plan of Lots for Country and
    21  Town Homes, Inc., prepared by D. P. Raffensperger, Registered
    22  Surveyor, in Lemoyne, Pa., dated October 25, 1955, which Plan
    23  was recorded in the Cumberland County Recorder's Office on May
    24  14, 1956, in Plan Book 7, Page 41.
    25     Having thereon erected a one story brick dwelling known as
    26  No. 7 Kensington Drive.
    27     Being the same Premises conveyed to the Commonwealth of
    28  Pennsylvania by deed of Rodney A. Felix and Velma R. Felix, his
    29  wife, dated August 5, 1968, and recorded September 20, 1968, in
    30  the Recorder of Deeds Office of Cumberland County in Deed Book

     2     Tract No. 2.  All that certain lot or piece of ground with
     3  the buildings and improvements thereon erected, situate in the
     4  Township of Lower Allen, County of Cumberland and State of
     5  Pennsylvania, more particularly bounded and described by a
     6  Survey of D. P. Raffensperger, Registered Surveyor, made May 7,
     7  1959.
     8     Beginning at a point on the Northerly line of Kensington
     9  Drive (50 feet wide) which point is 170.20 feet measured
    10  Westwardly from the intersection of the said Kensington Drive
    11  with Scarsdale Drive, and which point is on the line dividing
    12  Lots Nos. 2 and 4, Block "A", on the hereinafter mentioned Plan
    13  of Lots thence along Kensington Drive aforesaid in an arc having
    14  a radius of 160 feet in a Westerly direction, an arc distance of
    15  70 feet to a point in the line dividing Lots Nos. 4 and 5, Block
    16  "A", on the aforesaid plan; thence North 21 degrees, 42 minutes
    17  West along said dividing line 147.85 105.40 feet to a stake in    <--
    18  the Southerly right of way line of new Route 15; thence North 55  <--
    19  58 degrees 20 minutes 59 MINUTES 34.5 SECONDS East along said     <--
    20  line 75.69 37.47 feet to a POINT; THENCE NORTH 67 DEGREES; 03     <--
    21  MINUTES 20 SECONDS EAST 48.82 FEET TO A stake in the line
    22  dividing Lots Nos. 3 and 4, Block "A", on the said plan; thence
    23  South 34 degrees 40 minutes East along said dividing line 109.99  <--
    24  56.36 feet to a stake; thence South 1 degree 11 minutes West
    25  along the line dividing Lots 2 and 4, Block "A" on said plan,
    26  78.91 feet to a point in the Northerly line of Kensington Drive,
    27  being the place of Beginning CONTAINING 0.236 ACRES.              <--
    28     Being Lot No. 4, Block "A" on Plan of Lots known as Country
    29  and Town Homes, Inc. which plan is recorded in the Office for
    30  the Recording of Deeds in and for Cumberland County,

     1  Pennsylvania in Plan Book 7, Page 41. House No. 5 Kensington
     2  Drive.
     3     Being the same premises conveyed to the Commonwealth of
     4  Pennsylvania by deed of Charles J. Boova and Naomi M. Boova, his
     5  wife, dated August 16, 1968, and recorded September 16, 1968, in
     6  the Recorder of Deeds Office of Cumberland County in Deed Book
     7  X-22, Page 969.
     8     These conveyances shall be made under and subject,
     9  nevertheless, to all easements, servitudes and rights of others,
    10  including, but not confined to streets, roadways, and rights of
    11  any telephone, telegraph, water, electric, gas or pipeline
    12  companies, as well as under and subject, nevertheless, to any
    13  estate or tenancies vested in third persons, whether or not
    14  appearing of record, for any portion of the said land or
    15  improvements erected thereon.
    16     Section 2.  The deed of conveyance shall be approved by the
    17  Department of Justice and shall be executed by the Secretary of
    18  Property and Supplies in the name of the Commonwealth of
    19  Pennsylvania.
    20     Section 3.  All moneys received from the sale of the lands
    21  herein authorized to be conveyed shall be deposited in the Motor
    22  License Fund.
    23     Section 4.  This act shall take effect immediately.
