AN ACT 1 Providing scholarships for certain dependents of members of the 2 armed services who while on active duty are taken as 3 prisoners of war or are reported missing in action and making 4 an appropriation. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. Definitions.--As used in this act: 8 (1) "Qualified dependent" means the child of a member of the 9 armed services who served on active duty after January 31, 1955 10 and who (i) has been or is a prisoner of war or is reported as 11 missing in action and (ii) was a resident of Pennsylvania for at 12 least twelve months preceding his service on active duty. The 13 term does not include the child of any such member of the armed 14 services who deserted, defected to the enemy, or has otherwise 15 been discharged under other than honorable conditions. 16 (2) "Approved program of education" means any degree or non- 17 degree curriculum or course of study to be pursued on at least 18 one-half time basis for a duration of at least one academic year 19 or its equivalent at an approved institution of higher learning.
1 (3) "Approved institution of higher learning" shall mean any 2 institution of higher learning approved by the agency. 3 Section 2. Scholarships for Qualified Dependents.--From the 4 funds appropriated under this act and by the General Assembly 5 from time to time for the purposes of this act, the Pennsylvania 6 Higher Education Assistance Agency is hereby authorized to 7 provide scholarships to qualified dependents enrolled in 8 approved programs of education whose eligibility under the 9 provisions of the act of January 25, 1966 (P.L.1546), entitled 10 "An act providing scholarships and providing funds to secure 11 Federal funds for qualified students of the Commonwealth of 12 Pennsylvania who need financial assistance to attend 13 postsecondary institutions of higher learning, making an 14 appropriation, and providing for the administration of this 15 act," shall be determined without regard to the financial status 16 of their parents or the scholastic achievement test score of the 17 qualified dependent. 18 Section 3. Amount of Scholarship.--Scholarships awarded 19 under this act to cover full-time study shall not exceed, per 20 academic year, the tuition and fee charges at the institution of 21 higher learning at which the applicant is enrolled or twelve 22 hundred dollars ($1,200), whichever is the lesser. Scholarships 23 covering less than full time and at least one-half time study 24 shall be in a proportionate amount. 25 Section 4. Appropriation.--The sum of forty thousand dollars 26 ($40,000) is hereby appropriated to the Pennsylvania Higher 27 Education Assistance Agency to be transferred at the request of 28 the agency and deposited in the Higher Education Assistance Fund 29 for the purpose and administration of this act. 30 Section 5.
