                                     AN ACT

     1  Amending the act of April 29, 1959 (P.L.58), entitled "An act
     2     consolidating and revising the Vehicle Code, the Tractor
     3     Code, the Motor Vehicle Financial Responsibility Act and
     4     other acts relating to the ownership, possession and use of
     5     vehicles and tractors," requiring police officers to be in
     6     police uniform and motor vehicles used by them to be marked
     7     as police vehicles when making arrests or stopping vehicles
     8     for summary violations.

     9     The General Assembly of the Commonwealth of Pennsylvania
    10  hereby enacts as follows:
    11     Section 1.  The act of April 29, 1959 (P.L.58), known as "The
    12  Vehicle Code," is amended by adding a section to read:
    13     Section 1203.2.  Arrest for Summary Violations.--No police
    14  officer shall stop a motor vehicle or tractor for a summary
    15  violation of this act, or arrest any operator of a motor vehicle
    16  or tractor for any summary violation of this act between sunset
    17  and sunrise, unless such police officer shall be in police
    18  uniform, and any motor vehicle used by him in stopping the
    19  vehicle or tractor in making the arrest shall be plainly marked
    20  as a police vehicle.
    21     Penalty.--Any police officer violating the provisions of this


     1  act shall, upon summary conviction before a magistrate, be
     2  sentenced to pay a fine of twenty-five dollars ($25.00) and
     3  costs of prosecution, and in default thereof shall undergo
     4  imprisonment for not more than ten (10) days.
