AN ACT 1 Providing for the compensation of county officers in counties of 2 the second through eighth classes, for the disposition of 3 fees, for filing of bonds 4 in certain cases and for duties of certain officers. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. 1 (5) Counties of the fifth class............... 13,000 2 (6) Counties of the sixth class............... 11,000 3 (7) Counties of the seventh class............. 9,500 4 (8) Counties of the eighth class.............. 8,000 5 (b) Every county treasurer shall perform the duties now or 6 hereafter required by law, and shall be an issuing agent of the 7 Commonwealth of Pennsylvania for the sale of hunting licenses, 8 fishing licenses, and dog licenses, and comply with the laws 9 relating thereto and the rules and regulations of the Secretary 10 of Revenue. 11 Section 4. The annual salaries of county controllers and 12 auditors shall be as follows: 13 (1) Counties of the second class.............. $24,000 14 (2) Counties of the second class A............ 20,500 15 (3) Counties of the third class............... 17,500 16 (4) Counties of the fourth class.............. 15,500 17 (5) Counties of the fifth class............... 13,000 18 (6) Counties of the sixth class where the 19 office of controller exists or may be 20 created................................... 11,000 21 (7) Counties of the seventh class where the 22 office of controller exists or may be 23 created................................... 9,500 24 (8) Counties of the eighth class where the 25 office of controller exists or may be 26 created................................... 8,000 27 The county auditors in counties of the sixth, seventh, and 28 eighth classes, where the office of controller does not exist, 29 shall each receive thirty dollars ($30) for each six hours of 30 work in the discharge of their duties, together with twelve 19710S0603B1327 - 3 -
1 cents (12¢) per circular mile from and to their homes, once, 2 each and every day so employed. 3 Section 5. (a) The annual salaries of recorders of deeds 14 shall be as follows: 15 (1) Counties of the second class.............. $24,000 16 (2) Counties of the second class A............ 20,500 17 (3) Counties of the third class............... 17,500 18 (4) Counties of the fourth class.............. 15,500 19 (5) Counties of the fifth class............... 13,000 20 (6) Counties of the sixth class............... 11,000 21 (7) Counties of the seventh class............. 9,500 22 (8) Counties of the eighth class.............. 8,000 23 (b) The recorder of deeds shall perform the duties now or 24 hereafter required by law, and shall be the collection agent for 25 the Commonwealth of Pennsylvania of the Pennsylvania realty 26 transfer tax, and shall comply with the laws relating thereto 27 and the rules and regulations of the Secretary of Revenue. 28 (c) The recorder of deeds shall be the collection agent for 29 any political subdivision levying a local realty transfer tax 30 without compensation from the political subdivision. 1 before the tenth of each month, the recorder of deeds shall pay 2 over to the appropriate political subdivision all local realty 3 transfer taxes collected, less two per cent for use of the 4 county, together with a report containing the information as is 5 required by the Commonwealth of Pennsylvania in reporting 6 collections of the Pennsylvania realty transfer tax. The 7 recorder of deeds shall pay the two per cent withheld to the 8 county. The county shall obtain and pay the premium or premiums 9 on any bond or bonds necessary to cover the performance of the 10 recorder of deeds' duties under this subsection. 11 Section 7. (a) The annual salaries of registers of wills 12 shall be as follows: 13 (1) Counties of the second class.............. $24,000 14 (2) Counties of the second class A............ 20,500 15 (3) Counties of the third class............... 17,500 16 (4) Counties of the fourth class.............. 15,500 17 (5) Counties of the fifth class............... 13,000 18 (6) Counties of the sixth class............... 11,000 19 (7) Counties of the seventh class............. 9,500 20 (8) Counties of the eighth class.............. 8,000 21 (b) The registers of wills shall perform the duties now or 22 hereafter required by law, and shall be the agent of the 23 Commonwealth of Pennsylvania for the collection of Pennsylvania 24 transfer inheritance and estate taxes in the case of resident 25 decedents under the supervision of the Secretary of Revenue and 26 pursuant to the rules and regulations of the Secretary of 27 Revenue. 28 Section 8. The annual salaries of prothonotaries, clerks of 29 the criminal court division of the courts of common pleas and 30 clerks of the orphans' court division of the courts of common 19710S0603B1327 - 5 -

The annual salaries of jury commissioners shall 21 be as follows: 22 (1) Counties of the second class.............. $16,700 23 (2) Counties of the second class A............ 6,000 24 (3) Counties of the third class............... 2,500 25 (4) Counties of the fourth class.............. 1,800 26 (5) Counties of the fifth class............... 1,300 27 (6) Counties of the sixth class............... 1,000 28 (7) Counties of the seventh class............. 800 29 (8) Counties of the eighth class.............. 600 30 Section 11. Where any of the officers herein mentioned hold 19710S0603B1327 - 6 -
1 two or more of the offices for which a salary is herein fixed, 2 he shall receive the highest salary fixed for any one of the 3 offices which he holds, plus an additional amount of one 4 thousand dollars ($1,000) per annum. 5 Section 12. (a) The county officers shall be paid only the 6 salary provided herein for services performed for the county or 7 any other governmental unit: Provided, however, That this 8 restriction shall not apply to those county officers receiving a 9 salary as executive and administrative officers of institution 10 districts existing in their counties. 11 (b) All fees and commissions received in the conduct of any 12 county office shall be paid directly to the county. Fees shall 13 not be deemed to include reimbursement for mileage. 14 Section 13. The provisions of this act shall be severable. 15 If any word, phrase, clause, sentence, section or provision of 16 this act is for any reason held to be unconstitutional, the 17 decision of the court shall not affect or impair any of the 18 remaining provisions of this act. It is hereby declared as the 19 legislative intent that this act would have been adopted had 20 such unconstitutional word, phrase, clause, sentence, section or 21 provision thereof not been included herein. 22 Section 14. This act shall take effect the first Monday of <-- 23 January, 1972. IMMEDIATELY. In the event that any stabilization <-- 24 of wages and salaries shall be in effect pursuant to any 25 executive order of the President of the United States under the 26 Economic Stabilization Act of 1970 (P.L.91-379, 84 Stat.799), 27 the provisions of this act shall take effect at the termination 28 of such wage or salary stabilization.
