AN ACT 1 Providing for the compensation of county officers in counties of 2 the second through eighth classes, for the disposition of 3 fees, for filing of bonds 4 in certain cases and for duties of certain officers. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. The annual salaries of county controllers and 15 auditors shall be as follows: 16 (1) Counties of the second class.............. $24,000 17 (2) Counties of the second class A............ 20,500 18 (3) Counties of the third class............... 17,500 19 (4) Counties of the fourth class.............. 15,500 20 (5) Counties of the fifth class............... 13,000 21 (6) Counties of the sixth class where the 22 office of controller exists or may be 23 created................................... 11,000 24 (7) Counties of the seventh class where the 25 office of controller exists or may be 26 created................................... 9,500 27 (8) Counties of the eighth class where the 28 office of controller exists or may be 29 created................................... 8,000 30 The county auditors in counties of the sixth, seventh, and 19710S0603B1268 - 3 -
1 eighth classes, where the office of controller does not exist, 2 shall each receive thirty dollars ($30) for each six hours of 3 work in the discharge of their duties, together with twelve 4 cents (12¢) per circular mile from and to their homes, once, 5 each and every day so employed. 6 Section 5. (a) The annual salaries of recorders of deeds 17 shall be as follows: 18 (1) Counties of the second class.............. $24,000 19 (2) Counties of the second class A............ 20,500 20 (3) Counties of the third class............... 17,500 21 (4) Counties of the fourth class.............. 15,500 22 (5) Counties of the fifth class............... 13,000 23 (6) Counties of the sixth class............... 11,000 24 (7) Counties of the seventh class............. 9,500 25 (8) Counties of the eighth class.............. 8,000 26 (b) The recorder of deeds shall perform the duties now or 27 hereafter required by law, and shall be the collection agent for 28 the Commonwealth of Pennsylvania of the Pennsylvania realty 29 transfer tax, and shall comply with the laws relating thereto 30 and the rules and regulations of the Secretary of Revenue. 19710S0603B1268 - 4 -
1 (c) The recorder of deeds shall be the collection agent for 2 any political subdivision levying a local realty transfer tax 3 without compensation from the political subdivision. On or 4 before the tenth of each month, the recorder of deeds shall pay 5 over to the appropriate political subdivision all local realty 6 transfer taxes collected, less two per cent for use of the 7 county, together with a report containing the information as is 8 required by the Commonwealth of Pennsylvania in reporting 9 collections of the Pennsylvania realty transfer tax. The 10 recorder of deeds shall pay the two per cent withheld to the 11 county. The county shall obtain and pay the premium or premiums 12 on any bond or bonds necessary to cover the performance of the 13 recorder of deeds' duties under this subsection. 14 Section 7. (a) The annual salaries of registers of wills 15 shall be as follows: 16 (1) Counties of the second class.............. $24,000 17 (2) Counties of the second class A............ 20,500 18 (3) Counties of the third class............... 17,500 19 (4) Counties of the fourth class.............. 15,500 20 (5) Counties of the fifth class............... 13,000 21 (6) Counties of the sixth class............... 11,000 22 (7) Counties of the seventh class............. 9,500 23 (8) Counties of the eighth class.............. 8,000 24 (b) The registers of wills shall perform the duties now or 25 hereafter required by law, and shall be the agent of the 26 Commonwealth of Pennsylvania for the collection of Pennsylvania 27 transfer inheritance and estate taxes in the case of resident 28 decedents under the supervision of the Secretary of Revenue and 29 pursuant to the rules and regulations of the Secretary of 30 Revenue. 19710S0603B1268 - 5 -

3 Section 11. Where any of the officers herein mentioned hold
4 two or more of the offices for which a salary is herein fixed,
5 he shall receive the highest salary fixed for any one of the
6 offices which he holds, plus an additional amount of one
7 thousand dollars ($1,000) per annum.
8 Section 12. (a) The county officers shall be paid only the
9 salary provided herein for services performed for the county or
10 any other governmental unit: Provided, however, That this
11 restriction shall not apply to those county officers receiving a
12 salary as executive and administrative officers of institution
13 districts existing in their counties.
14 (b) All fees and commissions received in the conduct of any
15 county office shall be paid directly to the county. Fees shall
16 not be deemed to include reimbursement for mileage.
17 SECTION 13. THE PROVISIONS OF THIS ACT SHALL BE SEVERABLE. <--
18 IF ANY WORD, PHRASE, CLAUSE, SENTENCE, SECTION OR PROVISION OF
19 THIS ACT IS FOR ANY REASON HELD TO BE UNCONSTITUTIONAL, THE
20 DECISION OF THE COURT SHALL NOT AFFECT OR IMPAIR ANY OF THE
21 REMAINING PROVISIONS OF THIS ACT. IT IS HEREBY DECLARED AS THE
22 LEGISLATIVE INTENT THAT THIS ACT WOULD HAVE BEEN ADOPTED HAD
23 SUCH UNCONSTITUTIONAL WORD, PHRASE, CLAUSE, SENTENCE, SECTION OR
24 PROVISION THEREOF NOT BEEN INCLUDED HEREIN.
25 Section 13 14. This act shall take effect the first Monday <--
26 of January, 1972. In the event that any stabilization of wages
27 and salaries shall be in effect pursuant to any executive order
28 of the President of the United States under the Economic
29 Stabilization Act of 1970 (P.L.91-379, 84 Stat.799), the
30 provisions of this act shall take effect at the termination of

1 such wage or salary stabilization. and, after April 23, 1972, to <-- 2 every county officer holding office who was elected on November 3 4, 1969, or appointed to fill the unexpired term of a county 4 officer elected on November 4, 1969. D7L16JW/19710S0603B1268 - 8 -
