AN ACT 1 To provide for the expenses of the Executive, Legislative and 2 Judicial Departments of the Commonwealth, the public debt and 3 for the public schools for the fiscal year July 1, 1970 to 4 June 30, 1971, and for the payment of bills incurred and 5 remaining unpaid at the close of the fiscal period ending 6 June 30, 1970. 7 The General Assembly of the Commonwealth of Pennsylvania 8 hereby enacts as follows: 9 Section 1. This act shall be known and may be cited as "The 10 General Appropriation Act of 1970." 11 Section 2. The following sums, or as much thereof as may be 12 necessary, are hereby specifically appropriated from the General 13 Fund to the several hereinafter named agencies of the Executive, 14 Legislative and Judicial Departments of the Commonwealth for the 15 payment of the salaries, wages or other compensation and travel 16 expense of the duly elected or appointed officers and employes 17 of the Commonwealth, for payment of fees of contractual services 18 rendered, for the purchase or rental of goods, services, 19 printing, equipment, land and buildings and for payment of any 20 other expenses, as provided by law or by this act, necessary for
1 the proper conduct of the duties, functions and activities and 2 for the purposes hereinafter set forth for the fiscal year 3 beginning July 1, 1970, and for the payment of bills incurred 4 and remaining unpaid at the close of the fiscal period ending 5 June 30, 1970. 6 I. This act is not intended to be inconsistent with 21 or to repeal any provision of any act enacted at this or any 22 prior session of the General Assembly regulating the purchase of 23 supplies, the ordering of printing and binding, the purchase, 24 maintenance and use of automobiles, the method of making 25 payments from the State Treasury for any purpose or the 26 functioning of any administrative department, board or 27 commission. 28 Section 4. 1 board, commission or agency shall have complied with sections 2 604, 605 and 606 of the Administrative Code of 1929. 3 Section 5. The term "employes" as used in this act shall 4 include all directors, superintendents, bureau or division 5 chiefs, assistant directors, assistant superintendents, 6 assistant chiefs, experts, scientists, engineers, surveyors, 7 draftsmen, accountants, secretaries, auditors, inspectors, 8 examiners, statisticians, marshals, clerks, stenographers, 9 bookkeepers, messengers and other assistants in any department, 10 board or commission. 11 Section 6. The term "expenses" and "maintenance" shall 12 include all printing, binding and stationery, food and forage, 13 materials and supplies, traveling expenses, training, motor 14 vehicle supplies and repairs, freight, express and cartage, 15 postage, telephones and telegraph rentals and toll charges, 16 newspaper advertising and notices, fuel, light, heat, power and 17 water, repairs or reconstruction of equipment, buildings and 18 facilities, rent of real estate and equipment, premiums on 19 workmen's compensation, insurance premiums on policies of 20 liability insurance, premiums on medical payment insurance and 21 surety bonds for volunteer workers, premiums on employe group 22 life insurance, and employe and retired employe group hospital 23 and medical insurance, payment of Commonwealth share of social 24 security taxes for State employes, the purchase of replacement 25 or additional equipment and machinery and all other incidental 26 costs and expenses, including payment to the Department of 27 Property and Supplies of mileage and other charges for the use 28 of automobiles and of expenses or costs of services incurred 29 through the Purchasing Fund. The term "expenses" also shall 30 include the medical costs for the treatment of inmates of State 19710S0329B0382 - 60 -
1 institutions when the inmate must be transferred to an outside 2 hospital: Provided, That in no case shall the State institution 3 pay more for patient care than that provided under the State 4 medical assistance program. 5 Section 7. Purchase of supplies, materials and equipment 6 shall not be deemed to be committed or encumbered until 7 contracts covering said purchase have been entered into with the 8 vendors. 9 Section 8. In addition to the amounts appropriated by this 10 act, moneys received in payment for food and household supplies 11 furnished to employes and other persons, except inmates by an 12 institution, and moneys received from the proceeds from the sale 13 of any products of the soil, meats, livestock, timber, or other 14 materials sold by the department shall be paid into the General 15 Fund and are hereby appropriated out of the General Fund to the 16 several respective institutions for the operation and 17 maintenance of said institutions. 18 Further, in addition to the amounts appropriated by this act, 19 all moneys received from the Federal Government, or from any 20 other source as contributions for the programs provided herein, 21 or as payment for services or materials furnished by one 22 institution to another, except those collections designated as 23 revenues, shall be paid into the General Fund and are hereby 24 appropriated out of the General Fund for the purposes of the 25 respective appropriations. 26 Section 9. That part of all appropriations in this act 27 unexpended, uncommitted and unencumbered as of June 30, 1971 28 shall automatically lapse as of that date. 29 Section 10. The provisions of this act shall be severable. 30 If any provision of this act is found by a court of record to be 19710S0329B0382 - 61 -
1 unconstitutional and void, the remaining provisions of the act 2 shall nevertheless, remain valid unless the court finds the 3 valid provisions of the law are so essentially inseparably 4 connected with and depend upon the void provision that it cannot 5 be presumed the General Assembly would have enacted the 6 remaining valid provisions without the void one, or unless the 7 court finds the remaining valid provisions standing alone are 8 incompleted and are incapable of being executed in accordance 9 with the legislative intent. 10 Section 11.
