        AS AMENDED ON SECOND CONSIDERATION, FEBRUARY 19, 1971

                                     AN ACT

     1  To provide for the expenses of the Executive, Legislative and
     2     Judicial Departments of the Commonwealth, the public debt and
     3     for the public schools for the fiscal year July 1, 1970 to
     4     June 30, 1971, and for the payment of bills incurred and
     5     remaining unpaid at the close of the fiscal period ending
     6     June 30, 1970.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  This act shall be known and may be cited as "The
    10  General Appropriation Act of 1970."
    11     Section 2.  The following sums, or as much thereof as may be
    12  necessary, are hereby specifically appropriated from the General
    13  Fund to the several hereinafter named agencies of the Executive,
    14  Legislative and Judicial Departments of the Commonwealth for the
    15  payment of the salaries, wages or other compensation and travel
    16  expense of the duly elected or appointed officers and employes
    17  of the Commonwealth, for payment of fees of contractual services
    18  rendered, for the purchase or rental of goods, services,
    19  printing, equipment, land and buildings and for payment of any
    20  other expenses, as provided by law or by this act, necessary for

     1  the proper conduct of the duties, functions and activities and
     2  for the purposes hereinafter set forth for the fiscal year
     3  beginning July 1, 1970, and for the payment of bills incurred
     4  and remaining unpaid at the close of the fiscal period ending
     5  June 30, 1970.
     6                      I.  EXECUTIVE DEPARTMENT
     7                          To the Governor
     8     For the salaries, wages and all necessary
     9  expenses for the following purposes and
    10  activities, including the maintenance of the
    11  executive mansion, the expense of entertainment
    12  of official guests and members of the General
    13  Assembly and the Judiciary, participation in the
    14  Governor's Conference, the expenses of the
    15  Executive Board, and for the payment of travel-
    16  ing expenses of persons other than employes of
    17  the Commonwealth appointed by the Governor to
    18  represent the Commonwealth:
    19     Administration of the office of the Governor..       $988,000
    20     For the administration and operation of the
    21  Office of Administration and for the adminis-
    22  tration and operation of the Office of the
    23  Budget Secretary..................................     1,932,000
    24  In addition to this amount all moneys received
    25  from the Federal Government or from any other
    26  source or as reimbursement for expenses in-
    27  curred in the administration of the Civil
    28  Service Act shall be paid into the General
    29  Fund and credited to this appropriation.

    29  expenses for the proper conduct of the
    30  following purposes and activities:

     3  periodically or specially, the affairs of
     4  any department, board or commission which
     5  are supported out of the General Fund
     6  and for auditing justices of the peace,

     8  Relief Association Funds and the offices

     7  animals destroyed in disease eradication

     9     For the control of stem rust of wheat,
    10  oats, barley and rye by the eradication of
    11  rust spreading barberry bushes and providing
    12  for payment thereof to counties making
    13  like expenditures of county funds.................        20,000
    14     The following sum, or as much thereof as
    15  may be necessary is hereby appropriated out
    16  of the General Fund to be paid into the State
    17  Farm Products Show Fund to pay for that
    18  portion of the Farm Show and maintenance to
    19  Farm Show Building that is not paid from
    20  Farm Show revenues as provided in section
    21  1709 of The Administrative Code of 1929...........       340,000
    22     Development and operation of an open
    23  livestock show, including cattle, swine, sheep
    24  and horses:  Provided, That the department
    25  may make allocations of this appropriation
    26  as it deems appropriate to an incorporated
    27  association whose purposes are in accord
    28  with the purposes and intent of this
    29  appropriation, the funds so allocated to be
    30  used for the development and operation

     1  of a livestock show in Pennsylvania:
     2  And further provided, That the funds
     3  allocated by the department shall only be
     4  used for the specific items approved by
     5  the department in advance of the expenditure......        50,000
     6     Planning and staging of an open dairy show:
     7  Provided, That the department makes alloca-
     8  tions of this appropriation as it deems
     9  appropriate to an incorporated association
    10  whose purposes are in accord with the
    11  purposes and intent of this appropriation,
    12  the funds so allocated to be used for the
    13  planning and staging of a dairy show in
    14  Pennsylvania:  And further provided, That the
    15  funds allocated by the department shall only
    16  be used for the specific items approved by
    17  the department in advance of the expenditure......        50,000
    18     Promotion and holding of annual local,
    19  regional and State 4-H Clubs and Future
    20  Farmers of America dairy shows:  Provided,
    21  That the department may make allocations of
    22  this appropriation as it deems appropriate
    23  to an association whose purposes are in
    24  accord with the purposes and intent of this
    25  appropriation, the funds so allocated to be
    26  used for the development and operation of
    27  Junior Dairy Shows: And further provided,
    28  That the funds allocated by
    29  the department shall only be used
    30  for the specific items approved by the

     2     Payment of reimbursement to legally
     3  constituted law enforcement agencies for

     6     For the salaries, wages and all necessary

     9               To the State Council of Civil Defense
    10     For the salaries, wages and all necessary
    11  expenses for the proper administration of the
    12  State Council of Civil Defense, including

    18                   To the Department of Commerce
    19     For the salaries, wages and all necessary
    20  expenses for the proper administration of the
    21  Department of Commerce including the following:
    22  industrial development administration,
    23  economic development, promotion of tourist
    24  travel, business services and coal research.......     2,715,000
    25  In addition to this amount all moneys received
    26  from the Federal Government or from any other
    27  source as contributions for this program
    28  shall be paid into the General Fund and
    29  credited to this appropriation.
    30     For the payment of grants to recognized

     2  such agencies in the financing of their
     3  operational costs for the purposes of making
     4  studies, surveys and investigations, the
     5  compilation of data and statistics and in the
     6  carrying out of planning and promotional

     8     For industrial construction loans through
     9  the Pennsylvania Industrial Development
    10  Authority.........................................    10,000,000
    11     For the Governor's Science Advisory
    12  Committee to finance research and informa-
    13  tion dissemination projects to be conducted
    14  by the Pennsylvania State University for
    15  the benefit of Pennsylvania industry to insure
    16  more jobs for Pennsylvania........................       100,000
    17     For the Pennsylvania Science and Engineering
    18  Foundation to promote, stimulate, and encourage
    19  basic and applied scientific research and
    20  development and scientific and technological

    22     For the payment of grants to Appalachian
    23  Local Development Districts in accordance with
    24  the act of April 9, 1929 (P.L.177), as amended....        50,000

    30     For the purpose of making grants and pro-

    10     For payment of ceremonies in recognition

    13  Commission of Pennsylvania to plan and develop

    19  Department of Community Affairs, including

    28     For payment to the Pennsylvania Housing

     1  Of the sum hereby appropriated, an amount equal
     2  to two per cent of such appropriation may be
     3  used by the agency for the payment of expenses
     4  and costs of administration in carrying out
     5  the purposes for which the agency was created
     6  by law.
     7     For payments of grants to community action
     8  agencies as provided by the act of January
     9  26, 1968 (Act No. 9)..............................     1,300,000
    10     For the payments of grants for code enforce-
    11  ment assistance as authorized by the act of
    12  April 12, 1956 (P.L.1449).........................       785,000
    13  No more than twenty per cent of the
    14  amount herein appropriated shall be allo-
    15  cated or granted to any political subdivision.
    16     For the payment of housing assistance grants
    17  in accordance with section 4 of the
    18  act of May 20, 1949 (P.L.1633), known
    19  as the "Housing and Redevelopment Assistance
    20  Law" and its amendments...........................     3,000,000
    21  Of the sum hereby appropriated, an amount
    22  equal to up to two per cent of such appropriation
    23  may be used for the payment of the costs of
    24  administering section 4 of the Housing
    25  and Redevelopment Assistance Law.
    26     For the payment of grants for housing

    28  by the act of April 12, 1956 (P.L.1449) and
    29  its amendments, and for the payment of the costs

     8  to this appropriation.
     9     Payment of rental charges to The General
    10  State Authority for capital improvements at
    11  State-aided educational institutions..............     4,788,000
    12  In addition to this amount, all moneys received
    13  from the sublease of projects to State-aided
    14  institutions shall be paid into the General
    15  Fund and credited to this appropriation.
    16     Operation, maintenance and administration
    17  of the State colleges and State-owned
    18  university........................................    73,018,000
    19  And in addition to the above amount, all
    20  income and all moneys not subject to refund
    21  collected at the several State colleges and
    22  Indiana University or received from the
    23  Federal Government or from any other source
    24  and paid into the General Fund of the State
    25  Treasury under existing laws are hereby
    26  appropriated out of the General Fund to the
    27  several State colleges and Indiana University
    28  for the same purpose, each college and
    29  university to receive from such appropriation
    30  the exact amount which was collected at

     3  source during the said fiscal period.
     4     Operation, maintenance and administra-
     5  tion of the Pennsylvania State Oral School
     6  at Scranton.......................................       805,000
     7     Operation, maintenance and administration
     8  of Scotland School for Veterans' Children.........     2,200,000
     9  In addition to this amount, all moneys received
    10  from the Federal Government as contributions
    11  for this program shall be paid into the
    12  General Fund and credited to this appro-
    13  priation.
    14     Operation, maintenance and adminis-
    15  tration of the Thaddeus Stevens Trade School
    16  at Lancaster......................................     1,021,000
    17  And in addition to the above amount, all income
    18  and all moneys collected at the Thaddeus
    19  Stevens Trade School and paid into the
    20  General Fund of the State Treasury under
    21  existing laws are hereby appropriated out
    22  of the General Fund to the Thaddeus Stevens
    23  Trade School for the same purpose, the school
    24  to receive from such appropriations, the exact
    25  amount which was collected at said school
    26  during the said fiscal period.
    27     For payments of subsidies to school
    28  districts and county boards of school
    29  directors on account of basic instruction
    30  and vocational education costs:  Provided,

     1  That the Secretary of Education, with the
     2  approval of the Governor, may make payments
     3  from this appropriation in advance of the
     4  due date prescribed by law to school
     5  districts which are financially handicapped,
     6  whenever he shall deem it necessary to make
     7  such advanced payments to enable the school
     8  districts to keep their public schools
     9  open..............................................   826,970,000
    10  In addition to this amount, all moneys
    11  received from the Federal Government or from
    12  any other source as contributions for this
    13  program shall be paid into the General Fund
    14  and credited to this appropriation.
    15     For special emergency payments to school
    16  districts of the first class......................    15,000,000

    19     Payments to school districts on account
    20  of annual rental or sinking fund charges

     8  educational program needs, to improve the
     9  utilization of educational television, to
    10  evaluate the effectiveness of educational
    11  television and to produce programming.
    12     To provide funds for matching grants in
    13  accordance with Federal requirements for
    14  training programs under the Federal Manpower
    15  Development and Training Act of 1962 where
    16  such programs are approved by the Department

    18     To make grants or for purchasing, produc-
    19  ing, recording and distributing programming,
    20  or providing and procuring equipment and
    21  auxiliary services in connection with the
    22  establishment, operation and utilization
    23  of educational television and radio

    25  authorized by sections 523 and 525 of the
    26  act of March 10, 1949 (P.L.30)....................       850,000
    27     For payment to community colleges and
    28  technical institutes on account of capital

     3     Section 5.  The term "employes" as used in this act shall
     4  include all directors, superintendents, bureau or division
     5  chiefs, assistant directors, assistant superintendents,
     6  assistant chiefs, experts, scientists, engineers, surveyors,
     7  draftsmen, accountants, secretaries, auditors, inspectors,
     8  examiners, statisticians, marshals, clerks, stenographers,
     9  bookkeepers, messengers and other assistants in any department,
    10  board or commission.
    11     Section 6.  The term "expenses" and "maintenance" shall
    12  include all printing, binding and stationery, food and forage,
    13  materials and supplies, traveling expenses, training, motor
    14  vehicle supplies and repairs, freight, express and cartage,
    15  postage, telephones and telegraph rentals and toll charges,
    16  newspaper advertising and notices, fuel, light, heat, power and
    17  water, repairs or reconstruction of equipment, buildings and
    18  facilities, rent of real estate and equipment, premiums on
    19  workmen's compensation, insurance premiums on policies of
    20  liability insurance, premiums on medical payment insurance and
    21  surety bonds for volunteer workers, premiums on employe group
    22  life insurance, and employe and retired employe group hospital
    23  and medical insurance, payment of Commonwealth share of social
    24  security taxes for State employes, the purchase of replacement
    25  or additional equipment and machinery and all other incidental
    26  costs and expenses, including payment to the Department of
    27  Property and Supplies of mileage and other charges for the use
    28  of automobiles and of expenses or costs of services incurred
    29  through the Purchasing Fund. The term "expenses" also shall
    30  include the medical costs for the treatment of inmates of State

     1  institutions when the inmate must be transferred to an outside
     2  hospital: Provided, That in no case shall the State institution
     3  pay more for patient care than that provided under the State
     4  medical assistance program.
     5     Section 7.  Purchase of supplies, materials and equipment
     6  shall not be deemed to be committed or encumbered until
     7  contracts covering said purchase have been entered into with the
     8  vendors.
     9     Section 8.  In addition to the amounts appropriated by this
    10  act, moneys received in payment for food and household supplies
    11  furnished to employes and other persons, except inmates by an
    12  institution, and moneys received from the proceeds from the sale
    13  of any products of the soil, meats, livestock, timber, or other
    14  materials sold by the department shall be paid into the General
    15  Fund and are hereby appropriated out of the General Fund to the
    16  several respective institutions for the operation and
    17  maintenance of said institutions.
    18     Further, in addition to the amounts appropriated by this act,
    19  all moneys received from the Federal Government, or from any
    20  other source as contributions for the programs provided herein,
    21  or as payment for services or materials furnished by one
    22  institution to another, except those collections designated as
    23  revenues, shall be paid into the General Fund and are hereby
    24  appropriated out of the General Fund for the purposes of the
    25  respective appropriations.
    26     Section 9.  That part of all appropriations in this act
    27  unexpended, uncommitted and unencumbered as of June 30, 1971
    28  shall automatically lapse as of that date.
    29     Section 10.  The provisions of this act shall be severable.
    30  If any provision of this act is found by a court of record to be

     1  unconstitutional and void, the remaining provisions of the act
     2  shall nevertheless, remain valid unless the court finds the
     3  valid provisions of the law are so essentially inseparably
     4  connected with and depend upon the void provision that it cannot
     5  be presumed the General Assembly would have enacted the
     6  remaining valid provisions without the void one, or unless the
     7  court finds the remaining valid provisions standing alone are
     8  incompleted and are incapable of being executed in accordance
     9  with the legislative intent.
    10     Section 11.  This act shall take effect July 1, 1970.
