                                     AN ACT

     1  Authorizing the Secretary of Environmental Resources with the
     2     approval of the Governor, to transfer certain Project 70
     3     lands in Centre County to the Department of Transportation
     4     for a highway project under certain conditions.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Pursuant to the requirements of subsection (b) of
     8  section 20, act of June 22, 1964 (P.L.131), known as the
     9  "Project 70 Land Acquisition and Borrowing Act," the General
    10  Assembly authorizes the Secretary of Environmental Resources
    11  with the approval of the Governor, to transfer the hereinafter
    12  described land in College Township in Centre County to the
    13  Department of Transportation for a right-of-way for construction
    14  of Project L.R. 1050 section 2 involving relocation of Traffic
    15  Route 322.
    16     Such land shall be free of the restrictions on use and
    17  alienation prescribed by section 20, act of June 22, 1964
    18  (P.L.131), known as the "Project 70 Land Acquisition and
    19  Borrowing Act," upon:

     1     (1)  Reimbursement of the Project 70 Acqusition Fund or the
     2  Project 70 Land Acquisition Sinking Fund by the Department of
     3  Transportation from moneys in the Motor License Fund in an
     4  amount equal to the funds advanced by the Commonwealth for the
     5  purchase of the said land under the "Project 70 Land Acquisition
     6  and Borrowing Act," and
     7     (2)  The execution and filing of a document of release citing
     8  such reimbursement and release of the said land from the
     9  restrictions on use and alienation prescribed by subsection (b)
    10  of section 20 of said act.
    11     The document of release in such cases shall, upon such
    12  reimbursement, be prepared by the Attorney General and filed in
    13  the office of the recorder of deeds of the county in which the
    14  said land is located. Such reimbursement shall be paid by the
    15  State Treasurer into the Acquisition Fund if said fund is still
    16  active, or if such is not the case, into the Project 70 Land
    17  Acquisition Sinking Fund. Compliance with this subsection
    18  constitutes the express approval of the General Assembly of
    19  release of the restrictions on use or alienation of lands
    20  acquired by the Department of Transportation required by
    21  subsection (b) of section 20 of said act.
    22     Section 2.  The land and right-of-way to be transferred by
    23  the Secretary of Environmental Resources with the approval of
    24  the Governor to the Department of Transportation for a right-of-
    25  way for construction of Project L.R. 1050, section 2 to relocate
    26  Traffic Route 322 is more particularly described as follows:
    27                        Project Description
    28     Project L.R. 1050, section 2 beginning at a point on new
    29  location approximately 2700 feet west of L.R. 14016. Fox Hollow
    30  Road in Patton Township, approximately 0.75 miles northeast of

     1  Overlook Heights, thence in a southeasterly direction, and
     2  terminating at a point on new location approximately 3900 feet
     3  southeast of existing L.R. 14019 Branch Road, in College
     4  Township, approximately 0.57 miles south of Lemont Centre
     5  County, a distance of approximately 4.52 miles.
     6                      Right-of-way Description
     7     The right-of-way acquisition will affect two (2) "Project 70"
     8  sites, the first being located between Station 361+60 and
     9  Station 365+50 (total of 12.90 acres) having a maximum width of
    10  310 feet more or less. It will be necessary to acquire 2.44
    11  acres from the first site and 3.49 acres from the second site
    12  for the new highway.
    13     Section 3.  This act shall take effect immediately.
