AN ACT

Amending Title 53 (Municipalities Generally) of the Pennsylvania

Consolidated Statutes, in general provisions common to

optional plans, prohibiting certain acts by mayors and

treasurers in cities of the first class.

The General Assembly of the Commonwealth of Pennsylvania

hereby enacts as follows:

Section 1.  Title 53 of the Pennsylvania Consolidated

Statutes is amended by adding sections to read:

§ 3105.  Prohibited acts by mayor of first class city.

Notwithstanding any other provision of law to the contrary,

the mayor of a city of the first class is prohibited from

entering into any contract or other agreement with any party

that requires or provides for the expenditure of any funds from

the treasury of the city for services rendered during any period

in which a collective bargaining agreement with any employees of

the city has expired and a successive collective bargaining

agreement has not been ratified and approved by the city and the

employees subject to the collective bargaining agreement.

§ 3111.1.  Prohibited acts by treasurer of first class city.

Notwithstanding any other provision of law to the contrary,

the treasurer of a city of the first class shall be prohibited

from honoring any contract or agreement that violates section

3105 (relating to prohibited acts by mayor of first class city).

Section 2.  This act shall take effect in 60 days.
