AN ACT 1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated 2 Statutes, further providing for revocation or suspension of 3 operating privilege and for surrender of license. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Section 1532 of Title 75 of the Pennsylvania 7 Consolidated Statutes is amended by adding a subsection to read: 8 § 1532. Revocation or suspension of operating privilege. 9 * * * 10 (e) Commencement of revocation and suspension for certain 11 violations.-- 12 (1) The period of revocation or suspension provided in 13 this section shall commence upon the date of the person's 14 release from imprisonment imposed for a conviction, 15 adjudication of delinquency or consent decree granted under 16 42 Pa.C.S Ch.63 for a violation of any of the following 17 offenses: 18 (i) Section 3731.
1 (ii) Section 3732. 2 (iii) Section 3735. 3 (iv) Section 3735.1 (relating to aggravated 4 assault by vehicle while driving under the influence). 5 (2) When providing the certified record of a conviction, 6 adjudication of delinquency or consent decree granted under 7 42 Pa.C.S. Ch.63 to the department, the sentencing court 8 shall include in the certified record the date upon which the 9 person is to be released from imprisonment. In the event the 10 person is sentenced to an indeterminate period of 11 imprisonment, the court shall provide the department the 12 commencement date of any parole upon receiving notice of such 13 date from the Pennsylvania Board of Probation and Parole. 14 Section 2. Section 1540(a) of Title 75 is amended to read: 15 § 1540. Surrender of license. 16 (a) Conviction of offense.--Upon a conviction by a court of 17 competent jurisdiction for any offense which calls for mandatory 18 suspension in accordance with section 1532 (relating to 19 revocation or suspension of operating privilege), the court or 20 the district attorney shall require the surrender of any 21 driver's license then held by the defendant and shall forward 22 the driver's license together with a record of the conviction to 23 the department. [The] Except as provided in section 1532(e), 24 suspension or revocation shall be effective upon a date 25 determined by the court or district attorney or upon the date of 26 surrender of the license to the court or district attorney, 27 whichever shall first occur. 28 * * * 29 Section 3.
