        INTRODUCED BY PETERSON, BRIGHTBILL, ROCKS, CORMAN, WENGER,
           LOEPER, AFFLERBACH, SCANLON, REIBMAN, WILT, HOPPER,
           SALVATORE, PUNT, LEMMOND, MADIGAN, PORTERFIELD, FISHER,
           HELFRICK, PECORA, SHAFFER, JUBELIRER, SHUMAKER, BAKER AND
           RHOADES, MARCH 20, 1990

        AS REPORTED FROM COMMITTEE ON HEALTH AND WELFARE, HOUSE OF
           REPRESENTATIVES, AS AMENDED, SEPTEMBER 26, 1990

                                     AN ACT

     1  Amending the act of July 3, 1985 (P.L.164, No.45), entitled "An
     2     act relating to the prevention and reduction of premature
     3     death and disability in this Commonwealth; providing for
     4     assistance, coordination and support of the development and
     5     maintenance of a comprehensive emergency medical services
     6     system and for qualifications, eligibility and certification
     7     of emergency medical services personnel and licensing
     8     ambulance services; imposing powers and duties on the
     9     Department of Health; and making repeals," PROVIDING FOR       <--
    10     RECIPROCAL CERTIFICATION; relating to fund expenditures; and
    11     making an appropriation.

    12     The General Assembly of the Commonwealth of Pennsylvania
    13  hereby enacts as follows:
    14     Section 1.  Section 14(c) of the act of July 3, 1985           <--
    15  (P.L.164, No.45), known as the Emergency Medical Services Act,
    16  amended October 21, 1988 (P.L.1055, No.121), is amended to read:
    17     SECTION 1.  SECTION 11 OF THE ACT OF JULY 3, 1985 (P.L.164,    <--
    18  NO.45), KNOWN AS THE EMERGENCY MEDICAL SERVICES ACT, IS AMENDED
    19  BY ADDING A SUBSECTION TO READ:
    20  SECTION 11.  EMERGENCY MEDICAL SERVICES PERSONNEL.

     2     (L)  RECIPROCAL CERTIFICATION.--AN INDIVIDUAL WITH AN EMT OR
     3  EMT-PARAMEDIC CERTIFICATE LICENSE ISSUED BY ANOTHER STATE SHALL
     4  BE GRANTED RECIPROCAL CERTIFICATION BY THE COMMONWEALTH. THE
     5  DEPARTMENT SHALL RECOGNIZE RECERTIFICATION FROM A BORDER STATE
     6  OF ANY EMT OR EMT-PARAMEDIC AFFILIATED WITH AN AMBULANCE SERVICE
     7  WITH FIRST DUE RESPONSE IN THIS COMMONWEALTH AND A BORDER STATE.
     8     SECTION 2.  SECTION 14(C) OF THE ACT, AMENDED OCTOBER 21,
     9  1988 (P.L.1055, NO.121), IS AMENDED TO READ:
    10  Section 14.  Support of emergency medical services.

    12     (c)  Emergency Medical Services Operating Fund.--Money
    13  collected shall be paid to the court imposing the fine, or fee,
    14  which shall forward it to the State Treasurer for deposit into a
    15  special fund to be known as the Emergency Medical Services
    16  Operating Fund. [Moneys in the fund shall be appropriated
    17  annually by the General Assembly.] Commencing in the fiscal year
    18  1991-1992, and each year thereafter at least 80% of the total
    19  receipts to the fund for that fiscal year shall be appropriated
    20  by the General Assembly and expended by the department on an
    21  annual basis. In addition, at least 25% of any beginning
    22  unappropriated balance shall be appropriated and expended
    23  annually, provided that the ending unappropriated balance in the
    24  fund in any fiscal year shall be no less than $5,000,000, unless
    25  otherwise provided by the General Assembly. THE DEPARTMENT SHALL  <--
    26  FINANCE NO LESS THAN 80% OF THE COST OF TRAINING, CERTIFICATION
    27  AND RECERTIFICATION OF VOLUNTEER EMERGENCY MEDICAL TECHNICIANS
    28  AND EMT PARAMEDICS WHO ARE SPONSORED BY A VOLUNTEER AMBULANCE
    29  SERVICE.

     1     Section 2 3.  For the fiscal year 1990-1991, the amount of     <--
     2  $12,000,000 is hereby appropriated from the Emergency Medical
     3  Services Operating Fund to the Department of Health and the
     4  Catastrophic Medical and Rehabilitation Fund for Victims of
     5  Trauma to be expended in the fiscal year 1990-1991, as follows:
     6         (1)  For emergency medical services............$9,000,000
     7         (2)  For Catastrophic Medical and Rehabilitation
     8     Program............................................$3,000,000
     9     Section 3 4.  This act shall take effect July 1, 1990, or      <--
    10  immediately, whichever is later.
