SENATE BILL

                                     AN ACT

     1  Amending Title 20 (Decedents, Estates and Fiduciaries) of the
     2  Pennsylvania Consolidated Statutes, further providing for
     3  persons who may execute anatomical gift.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 8611(b) of Title 20 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 8611.  Persons who may execute anatomical gift.
     9     * * *
    10     (b)  Others entitled to donate anatomy of decedent.--Any of
    11  the following persons, in order of priority stated, when persons
    12  in prior classes are not available at the time of death, and in
    13  the absence of actual notice of contrary indications by the
    14  decedent or actual notice of opposition by a member of the same
    15  or a prior class, may give all or any part of the decedent's
    16  body for any purpose specified in section 8612:
    17         (1)  The spouse, unless there are persons who qualify
    18     under paragraph (2) who are not children of the surviving

     1     spouse, in which case their consent shall also be required.
     2         (2)  [An adult son or daughter] All adult children.
     3         (3)  Either parent.
     4         (4)  An adult brother or sister.
     5         (5)  A guardian of the person of the decedent at the time
     6     of his death.
     7         (6)  Any other person authorized or under obligation to
     8     dispose of the body.

    10     Section 2.  This act shall take effect in 60 days.
