AN ACT
1 Amending the act of October 1, 1981 (P.L.279, No.94), entitled
2 "An act providing for shade trees in incorporated towns,"
3 further providing for the membership of shade tree
4 commissions.
5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. Section 2 of the act of October 1, 1981 (P.L.279,
8 No.94), entitled "An act providing for shade trees in
9 incorporated towns," is amended to read:
10 Section 2. Composition of commission.
11 The commission shall be composed of [three] five residents of
12 the incorporated town, who shall be appointed by the council,
13 and shall serve without compensation. Whenever a shade tree
14 commission is established by any incorporated town, the council
15 shall appoint one member for a term of three years, [one] two
16 for [a term] terms of four years, and [one] two for [a term]
17 terms of five years. On the expiration of the term of any
18 commissioner, a successor shall be appointed by the council to
1 serve for a term of five years. Vacancies in the office of
2 commissioner shall be filled by the council for the unexpired
3 term. Three members of a commission shall constitute a quorum.
4 Section 2. As to the two additional members of a shade tree
5 commission provided for by this act, one shall be appointed for
6 a term of four years and one shall be appointed for a term of
7 five years.
8 Section 3. This act shall take effect in 60 days.
