AN ACT
1 Amending Title 3 (Agriculture) of the Pennsylvania Consolidated
2 Statutes, further providing for keeping and handling of
3 cervids.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 2380.6(a) of Title 3 of the Pennsylvania
7 Consolidated Statutes is amended to read:
8 § 2380.6. Keeping and handling of cervids.
9 (a) Pens, shelters and enclosures.--[The department shall
10 adopt regulations concerning the type and size of pens, shelters
11 and enclosures] A pen, shelter or enclosure may not be used for
12 Cervidae livestock operations[. Regulations shall ensure that]
13 unless there is a permit issued by the department. The
14 department shall issue permits only for pens, shelters or
15 enclosures [used to hold cervids are no less than ten feet from
16 the ground to the top, provide] which comply with all of the
17 following:
18 (1) Have reasonable height, considering the individual
1 circumstances of the permittee.
2 (2) Provide for the health and comfort of the cervids
3 [and be].
4 (3) Are designed, considering the individual
5 circumstances of the permittee, to protect the public[,] and
6 confine the cervids [and exclude the entity of wild cervids].

8 Section 2. This act shall take effect in 60 days.
